My then five year old daughter was given the wrong medication by Rite Aid; a year later, while fully admitting what they did, they're refusing to pay her six-figure medical bills.
My daughter and I were forced to move in with friends in CA immediately after the fact, because I had to leave my job in order to take care of her full-time; the event in NH, and they're banking on the fact that I don't want to repeatedly fly my little girl back to NH to sue them.
My little angel has gone from a bubbly, effervescent little girl who would begin her time on the playground running over to kids she didn't know and asking, "Would you like to be my friend?" to sitting listlessly on the bench, not meeting anyone's eyes. She can't stand it if she's out of my sight or my ex-husband's. They did more than almost take her life; they took her light. Her night terrors, her panic attacks, her migraine headaches, all from the result of nearly dying has put decades into my little baby girl's once dancing eyes.
I've begun countless online campaigns, and told my story to tens of thousands of people; over the summer I had ten thousand strong in my boycott, and hope more by the summer.
What bothers me most is that when I went online, and googled "Rite Aid, Lawuits", there were so many terrifying sites that came up. Most people who get the wrong medication die,so I was lucky in that respect. At one point the entire state of NY sued them. This is a company that is at best truly careless. And it almost cost me my child's life.
I've written a book and a screenplay about my baby's horrible experiences; but mostly I want people to know what she endured. I want people to be informed before they go into that store that claims they're "family friendly". They couldn't give a rip about family--they have shown no more remorse over what they did to my baby than they'd show over a fly they swatted. She is nothing to them. They have not so much as apologized for their mistake.
Please, I'm begging you--don't take your children to Rite Aid. If you have friends or family, tell them to google "Rite Aid Lawsuits" before they take their children there. Do not support these people. Do not risk your life, or even more importantly, your child's life with these people, because I promise you, they will not care at the end of the day.
I will not stop telling my story. I will make sure the PLANET knows that Jessica nearly died at the hands of a cruel corporate company whose sloppy policies have cost many lives.
Protect your family from these monsters. Protect your friends from these monsters. Walgreen's a fabulous, loving, caring company. Take your business there.

Mr. Jeffery Lenkhov is currently making attempts to settle the case at Rite Aid. He's a decent gentleman (he spent the day after Thanksgiving running for a breast cancer charity) and has been working very hard to try to settle the situation between us.

Just a few issues with your complaint.

I have just read your posts and frankly, there are parts of this story that just do not add up.
Firstly, I cannot understand the pharmacist giving the first dose. I have never known that happen. I don't understand why a busy pharmacist would want to, even if it was appropriate, which of course it isn't. I am surprised too that you allowed the pharmacist to do this. I certainly wouldn't and I don't think most parents would. The next issue that I have with this tale is that you say your daughter turned blue straight away. Did you call an ambulance? Did Jess go to hospital? You say she was forced to vomit through her sore throat. Do you mean that she had her stomach pumped? I also cannot fathom why you did not check the bottle there and then. It took you 9 hours. Just seems odd. What did the pharmacist say when you protested to him about this?
Did you and Jess get on Judge Alex? Did anyone buy your screenplay?
Another thing that seems to be a bit of gilding the lily is that you claim to have massive medical bills. Incredible bills. Much of your daughter's care relates to PTSD and panic attacks and insomnia. I'm sorry, but I have difficulty believing that a child this young would develop these psychological disorders. Certainly not because they swallowed a pill with a sore throat. I wonder if this is because of your reaction to this incident.
You do sound overly concerned about money here. You spend a lot of time explaining your plans to get a seven figure payout and to sell your screenplay and book. I don't want to do you an injustice, and you may well indeed be in dire financial straits. It isn't a particularly good look is all I'm saying.
I am sorry if I am misunderstanding things, and I hope I am, but I think your complaint would look more credible ( to me anyway ) if you could answer these issues.

Seems your imdb profile leaves alot out - who is your agent? Who posted the profile? My money is on you did this for yourself - boy you are really busy on stage and making a movie but you have all this time to make not one but TWO reports against this company as well as accessing a lawyer(s). Hum I smell SCAM.

Okay, this is bombast. Most adults - let alone parents - do not allow pharmacists to administer medications, and certainly most adults read the labels on the pill bottles before giving it to children. If they don't, then clearly they're not paying much attention or it's not a high priority, is it? As a parent, it is YOUR responsibility to check the medication and administer it. Not the pharmacist's. My cousin is a pharmacist, and he would no sooner put medication in a child's mouth than he would cut his own hand off.
Secondly, as for these internet campaigns, interviews, books, and screenplays of yours: I have seen not one whisper of your story anywhere but here. If you had had a boycott with 10,000 supporters, we'd have heard about it. And trust me, after your first post here, people will have looked.
Thirdly, if you HAD had such a monstrous boycott and a fairly solid case with decent evidence, just about any lawyer with even a modicum of brains would have taken your case on contingency, even though cases like this are hard to win and are marathons of jurisprudence. You would have had a few years' wait, but you would likely have gotten a healthy settlement.
All this sounds like to me is someone who sits back on her butt all day writing screenplays that will never be produced, doesn't really want to earn a living, and wallows in self-absorption.
Get a job.

I tried your suggestion to do a Google Search for lawsuits against Rite Aid. However, I additionally tried the same search for every other large prescription drug dispensing company out there that I could think of and it almost looked like the same list. In fact, you can do the same search for any large company and get huge lists of lawsuits. People, at least in America, LOVE to sue for anything to try to get rich quick.
Rite Aid is no different.

You recently began your internet campaign hoping for a big payday!
Funny, you claimed to have "immediately borrowed" $30,000 from a friend, and yet you didn't bother to use about $5000 to retain an attorney and file a lawsuit against Rite Aid. Why is that??? Instead, you moved to California and 2 years later, you still haven't filed a lawsuit.
The icing on the cake is your claim in your other ROR that you were looking to go on Judge Alex! LAUGHABLE!!! You claim to have over $150,000 in actual damages (medical bills) but you're willing to go on Judge Alex and settle for $5000 maximum? Your credibility is in the toilette!!!
I don't believe your nonsense, especially about the pharmacist administering the medication-NO pharmacist would do that, none, nada, nein. Special note: Rite Aid has surveilance camerals throughout their stores, if a pharmacist were to have done this, there would have been a video to prove it. But wait, instead of hiring an attorney immediately to file a suit and subpeona any such video, you borrow $30 K and move across the country. 2 years later, after you've written your book and screenplay, you go on the internet to "inform the world" about this! Okey dokey!
I would expect you to have filed many complaints with licensing authorities in NH, but heck I can't find them on line. Why is that?
Here's some free advice for you. The statute of limitations clock is COUNTING DOWN-if you don't file your lawsuit rather quickly, you will lose any hope of suing them (assuming the SOL is NOT already expired.)
Some more advice; The Boston lawyer will not be able to file the lawsuit in NH unless the lawyer is LICENCED to practice in NH.
I feel sorry for your daughter.

This "report" has been busted in many ways..but heck I was thinking let's see how good of a writer the OP is when(if) she responds to a few questions.
First you have left the impression that you have spent every waking hour taking care of your daughter. So exactly when did you have the time to not only write a Screenplay but a book as well?
So what happened from your previous report....
It sounded like you were going to sell your story within days and then use that money to file your suit. Obviously that didn't happen yet..so why not?
You had a "SHARK" attorney who was going to file a suit. Again if you had an "in" with this attorney why haven't they just filed the suit on a contingency basis?
You talked to people from Judge Alex who seemed interested. Are they no longer interested?

I often use Rite Aid and will continue to use them. They do a good job for me.
As critical as any medication can be, I don't EVER remember getting a medication that I didn't understand a) when the doctor prescribed it, b) when the pharmacist dispensed it to me, c) completely scanned the required information sheets provided by the pharmacist. If I have any questions I discuss it with the pharmacist and/or the doctor. I've actually had pharmacists question me about the medicine and wanted to make sure the doctor prescribed the right medication. A second check is always a good thing.
As much as it would be ideal that everyone is absolutely 100% perfect all the time, that's not the way it is in the real world. You need to take some responsibility for any health related issues, especially related to your kids. Double check your meds and certainly double or triple check your children's meds
I don't buy the force fed thing either.
Also, of course Rite Aid cares about their customers health, that's ridiculous, they are people too and don't want to cause any harm to anyone.
Sorry, I just don't buy this as written.
Incidentally, I do NOT nor have I ever worked for any pharmacy at all. I'm just a cautious consumer.

Are you posting again to find more supporters? Seems like the last post generated a lot of discussion about how you let the pharmacist administer the meds, didn't check the label, and were blowing this out of proportion. The medication your daughter took shouldn't cause the long term problems you suggested earlier.
