I went on line to check my bank statement on Friday 21st of April, and found a 21.95 drafted from my account on 4/17/06. I immediately called my bank Monday 24th to inquire about the draft. It had caused a NSF to my account. I was given a phone number to call, no name, just 1-866-543-8451.

I called the number and a lady answered the phone. I questioned the draft and told her I had not authorized anyone from Roadside Plus to do an electronic transer from my account. I had never heard of them before. She gave me a confirmation #E37921 and said they would reverse the charges. So I hung up the phone thinking it was taken care of.

That following Thursday 4-27-06 I again checked my account on line and found there had been no reversal of charges. I called the number again. I asked for her name and she said, Angela. I explained the situation above. She wanted my name so she could look up the account she stated. She said there was no such thing as a confirmation. I asked where she was located and an address.

She answered New York, but would not give me a physical address, said they did not have one. I said I think you better have one, since I must be doing business with you and you have taken funds from my bank account. She then stated we don't give refunds. I pressed the issue of was city she was located several times and she finally said Plattsburg. I began to inquire about their services, and she said hold on. Then another woman came on the line and started shouting, we don't give refunds and that is just tough, goodbye and hung up on me.

On April 29, I went to my bank and asked to file a report using the Federal Regulations E Form regarding a scam and had the Bank Manager look up all the reports about this company who had been scammed by this company. He made a copy of my report and told me he would get back with me in a few days.

That following Monday morning, Bank Manager for State Employees Credit Union called me and said he had spoke to the Roadside Plus and they told him I had signed up for a Roadside Plus Service. I insisted and reinterated that I had not signed up for such a service. He asked we would I be willing to call them one more time and ask them to send me an authorization form showing that I had authorized this service.

So on May 3rd, I called them again and Andrea answered the phone again. I was very polite, because I wanted them to stay on the line and not hang up until I made a request for an authorization. She asked for my last name, then said, it shows here you have cancelled your account. I asked her since I had seemed to have signed up for such a service with them and they had drafted the 21.95 from my account, what type service could I receive for the monies I had already paid to them. She answered Roadside Plus and would not go into any further detail. I told her I had not received any package of such services in the mail. She stated, oh we can reopen your account and you can use he services you have already paid for.

I again asked what kinds of services would I receive. She answered again. Roadside Plus and would not reiterate or explain the services to me that I qualified for. So, I said, ok, I've got a special request; please send me authorization that I have signed up for this service in the mail. She said, ahh, ok. I said can you send it today, she said, ah, probably will be more like the weekend. Today is Wednesday, May 10, and I still have not receive any authorization in the mail to prove that I signed up for this service.

I called my Bank Manager back again and told him the conversation that I had with them. I asked him to reverse the charges and he said since the transaction has already gone through, he could not reverse the charges and he said he had spoken to the people and they said they if he did reverse the charges back to them, that they would just send it back through. I asked the Bank Manager was there anyone else I could speak to like Bank Commissioners, and he said, we are a State Credit Union and I am the person you need to talk with and I will decide and will not help me any further. He suggest I contact the Better Business Bureau. He really has not informed me of my rights appropriately and neither has anyone else I have spoken to at the State Employee's Credit Union.

I have checked on line now with numerous accounts of scams dated back in November 2005 for this company and people are still filling complaints of being scammed by this company. It appears that this company has used numerous names and they have obtained information from numerous payday loan advances companies online that are supose to be secure sites, so apparently they have to be selling names and accounts numbers to these people.

So these pay day loan companies are illegally selling names, and also the bank drafts are being handled by another bank by the name of Innovative Bank. They seem to be handling the ACH accounts for this company. They have to know that this is a bogus company by now, but yet are still handling their accounts for them. They need to be stopped too! They need to be reported to the Federal Trade Commission and to State Dept. of Financial Institutions 111 Pine St., Suite 1100, San Francisco, CA 94111,Phone no. 415-263-8555, Toll Free: 1-800-622-0620 for consumer complaints or email consumer@dfi.ca.gov.

Also need to be reported to FDIC Headquarters, telephone no. 202-736-0000, mailing address: 550 17th St. NW, Washington, DC 20429-9990. They are responsible for all insured banks. Come on everyone that has been ripped off, please do your part and report Roadside Plus. Look up those sites I've mentioned above on line if they have a email address or call them direct, or write them, do what ever it takes. This is America and these people should be caught and prosecuted.

COMMENT:
I am beginning to wonder if this might be a terriost diversion of funds. I would hate to know that I have contributed to such a cause, even though it is unbenoest to me where all this money is going and who really is receiving these funds. I never agreed to such a transaction and neither at this time will my Credit Union Bank in NC assist me.

I plan to write the attorney general in NC and in NY., and the Commisioners if I can find out who they are for the State Employees Credit Union. As the Bank Manager stated to me, or suggested that there is no one except him to talk to about this situation and he will not refund my money. Does anyone have anymore suggestions on where else I might turn to beside the things I have stated above? I have noticed from some of the complaints that some banks are refunding the victims their money and some are not. How can that be?

I've also noted from different reports that it is not just one pay day loan company that is selling accounts, it is a large number of them, so maybe they all need to be checked out and find out if they are indeed selling names even though they claim they are a secure sight and are not doing anything illegal. If they are selling names, it is definitely illegal and violating my freedom and rights of an American. Just to mention a few names of these pay day sites that victims have noted in their reports that they have visited are: soniccash, 500fastcash, CashNet and Ichecktech has been mentioned. I know here are more than that, so please be very carefule who you give your ID's and information to. Pay attention to any payday site that you have inquired about and then pay attention shortly after that to you bank account for a 21.95 ACH drafted from your account for Roadside Plus, and report them to whom ever you think needs to know, including this site.

EDitor's Suggestions on how to get your money back!

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO:

Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish to file a dispute, and demand that they assist you in accordance with Federal Regulation E.

According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days.

If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 #, and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges.

Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent!

DO NOT TAKE NO FOR AN ANSWER!

Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/controller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get.

And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state.

Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth.

If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form.

CHARGES TO YOUR CREDIT CARD

If the charge was to your credit card (not debit card, check card, or checking account), contact the credit card company as soon as possible to request a dispute form. Consumers usually have a little longer to dispute fraudulent credit card charges (up to 6 months), but it is better to act right away. In this type of situation, credit card disputes are usually successful since fraudulent companies often won't contest the disputed charge. In rare cases, credit card companies will review disputes, but refuse to reverse the charges. If this occurs, complain to a manager and let them know you will be filing a report here.

Remember Don't let them get away with it! Make sure they make the Rip-off Report .. The more Reports filed on a Company or individual, the more likely it is that the authorities, media and attorneys will want to take action.
