This complaint is being filed against the Rockaway Beach Resort timeshare.

My father was conned into purchasing 100 timeshare weeks at this timeshare resort in 1995. My father purchased this timeshare on his own, and my mother has no recollection of ever signing any paperwork for them. This timeshare has been a cause of a lot of stress to my mother over the years. She took out a second mortgage on her home in order to pay them off.

They have continually increased the yearly maintenance dues at the timeshare. Right now, they are up to around roughly $45,000 per year!

My father passed away from cancer in 2002, shortly after my 16th birthday. My mother never remarried and had to raise her three underaged children, send us to college, and be the sole person responsible for finances in our family.

My mother is a widow and has been dealing with multiple health issues. After helping her review her finances, I discovered in October of 2013 that her maintenance dues were paid up and current to the end of the 2013 calender year. Her mortgage on the initial purchase of the timeshare were fully paid off and current. She owed no more money to Rockaway Beach Resort.

I made a phone call to the general manager of Rockaway Beach Resort, Don, on October 24, 2013. I explained to him, very nicely, that my mother was having hardship issues both with health and finances. She barely used this timeshare and could no longer afford these $45,000 a year maintenance dues. The timeshares were fully paid off, and the maintenance dues were current to the end of the 2013 calender year. I offered to give the 100 weeks back to the resort with no compensation in return. Don was very nice on the phone and sympathized with my mothers situation. He told me that Rockaway Beach would be willing to take the weeks back because they were paid off and current. He just wanted my mother to write a letter or email explaining the situation.

My mom sent the email asking to give back the timeshare weeks for no compensation. They sent a letter back on November 11, 2013. It denied our refund request, saying they only take weeks back on a "case-by-case basis."

We refuse to pay another dime for this timeshare scam. The timeshare resort hired a lawyer and sent us a letter dated April 18, 2014 threatening to foreclose on the timeshare and ruin my mothers good credit if we did not pay our 2014 $45,000 yearly maintenance dues. I then called the lawyer personally, and told him that forecloser is not necessary because we already offered to just give the weeks back for free. He said he doesn't care, the resort company had their own bills to pay plus attorney fees to pay (his attorney fees) and they want the money. The lawyer sent another letter dated July 7, 2014 and offered us a "deal" to pay his office $30,000 or else they were going to sue my mother. Once again, we won't pay another dime for this timeshare scam.

Don Osborne lied to me on the phone saying he would take our timeshare back. He scammed me and my mother by making her put her hardships in writing, on the record, to be able to use against us later. The timeshare resort do not treat their customers the same. They have taken other timeshare owners' weeks back. They do not hire lawyers and threaten lawsuits. They simply take the weeks back. Rockaway Beach Resort is in violation of the Oregon Unlawful Business, Trade Practices Law (ORS 646.607) as well as Oregon Abuse of Vulnerable Persons Law (ORS 124.110).

My sincere hope is both sides can walk away gracefully. We are simply asking Rockaway Beach Resort to stop the harassment of my mother, a widow with health problems. They can have their weeks back with no compensation in return.
