I am a landlord in La Jolla CA who is a very fair & honest person renting my personal home out at 5675 Bellevue Ave in Birdrock for 6 months to Kellogg Hooker & Allison Hooker, 1623 Avenue Cresta La Jolla CA 92037 since I had an opportunity to move to Los Angeles for work reasons. Kellogg Hooker (619) 459-1112 was a decent tenant until the day he was supposed to move out. His move out day was October 31, 2006. He and his lovely daughter Allison didn't move out of my house.

I drove down on several occasions to clean the house and get it ready to rent again but their "stuff" was never removed from my house. I even documented this by taking pictures with the front page of the San Diego Union Tribune in every picture documenting their items still in my house and documenting the areas that really showed that they never cleaned the house at all. He never turned the keys in to me....ever as the lease said he should.

Now, shoot ahead one & 1/2 years later to March 2008. I have a great new tenant in the property and out of the blue the San Diego County Sheriffs show up on his door step and at his job to subpoena me to court for TWO jnudgements. One that had already been passed through the courts far enough to show up on my credit report of $3394. This amount was the exact amount of his security deposit which he received within 21 days after move out. The tenant never cashes the check. After 180 days the check is invalid. Is it my responsibilty to hold his hand and take him to the bank and cash the check??? Judge Karen Riley thinks so.

The second judgement was totally fabricated. I could not even believe that these scum bags Kellogg Hooker & Allison Hooker could possibly come up with a scam such as this. The Hookers claimed that they had done $7,500 worth of "Emergency Plumbing Changes" in my home. As I looked at some of the receipts as I sat in court on Judgement Day, the receipts he submitted were receipts to his own houses that had plumbing work done on and he didn't even change the address on the top of the receipt where it says"Job Location". When I tried to explain my side or any part of my story, the wonderful Judge Karen Riley shut me down and told me that he was right and I was wrong. That fat ,horrible miss piggy looking judge didn't even care about any of my side and just wanted to go to lunch. Conveniently, the court reporter had left before my case so I could not even buy the records of what was said from the court reporter after to submit to my Insurance Company since the Hookers were screaming a "Liability" issue.

In addition, when I entered the court room that morning of May 5 2008, Kellogg Hooker, at least the Kellogg Hooker that I rented my house to was not in that court room. I know the man I rented to , and the man who was speaking for Kellogg Hooker was unknown to me. Now try explaining that at the last minute in the court room to a judge such as Karen Riley.

I always wondered "who does Kellogg & his beautiful daughter of crime Allison Hooker know in the San Diego Court system that they think they could get away with this kind of scam." Obviously Judge Karen Riley is part of the ring of scamming in the San Diego courts today. How does an individual prove this? I need some answers here myself but am not getting any help from the San Diego Superior Courts.

I did a background check on Kellogg Hooker prior to court on May 5 2008. He owns 3 properties within blocks of my La Jolla Birdrock home all of which is public records. 1207 Archer Street in Pacific Beach, 470 Nautilus St. La Jolla CA and 1623 Avenue Cresta in La Jolla CA 92037. The 470 Nautilus St is a 3 story business building which probably needs a lot of plumbing fixes as well as the the other two aging homes. He was probably trying to pawn those jobs off on me and Judge Karen Riley let him do it, hook, line and sinker.

I have no health insurance and am HIV Positive , I have been trying to find work for months in my profession in the medical field but with these incorrect Judgements showing up on my background checks, it's no wonder I'm not getting hired. Judge Karen Riley could care less that my health & retirement and life is swept away by a scam artist of Kellogg Hooker & Allison Hooker.

What does Judge Karen Riley get out of this? Anyone out there in the same predicament? Write me please if you are.

Allison Hooker and her father Kellogg John Hooker of La Jolla continue...

...to aggravate the owner of the house at 5675 Bellevue Ave La Jolla CA by teaching the current tenant Gregg T, Holdgrafer , Regional Manager at Guardian Insurance, 7676 Hazard Center Drive , San Diego , CA 92108 how he too can make money off the landlord/owner of the Bellevue home by falsifying receipts, escalating & duplicating costs on the receipts submitted to the court. The San Diego Court does not seem to care much that these tenants, and I'm sure many others across the United States, are falsifying documents to make money from the landlords. Since insurance companies are involved in this "Hooker Knock-Off" case, the court seems to default that the insurance companies should just pay out whatever amount the tenants submit, even if the receipts are fake or changed.

This does not seem like "Justice" to me...more like the easy way out for any judge to take. Unfortunately, it's being abused and hurting those trying to get ahead in life and secure a retirement fund of any sort. I guess this is where I say..."if that's the case, I want to be taken care of by the government too" and become a bum on welfare or disability or what ever assisted programs will take care of me.

Kellogg & Allyson Hooker of La Jolla CA run to Judge Karen Riley crying "he said something nasty but true about all of us"

I received this letter in the mail from the San Diego Superior Court in San Diego County from Judge Karen Rileys office.

Dear Mr Hooker:

Your letter dated July 7, 2008, addressed to the Honorable Karen A. Riley, Commissioner ("Commissioner Riley"), of the Superior Court of California , County of San Diego ("San Diego Superior Court"), has been referred to this office for action. Please be advised that judicial officers may not accept ex parte communications. As such, no action will be taken in the small claims cases referenced above.

Our office takes note of the false, scurrilous remarks concerning Commissioner Riley and the San Diego Superior Court on the referenced website (rip-off report)

My last comments on this whole scurrilous and illegally contrived judgment that KELLOGG & his daugter Alyson HOOKER made up and presented to the court 6 months after the daughter moved out of my house (The father only co-signed the 6 month lease for Alyson) and allowed to be passed through our court system, with the help of Judge Karen Riley is that these people stink! Get real jobs and stop ripping people off. Joe Pace of Pace Birdrock Realty in La Jolla , my real estate agent that i used to help fill my rental vacancy mentioned that Kellogg Hooker has done this before. Thanks Joe for giving me this huge problem. Did you get a cut somewhere too of the money this leach is stealing from me? Is it worth it?

You should have the right to appeal, inexpensively.

If you disagree with a decision against you in Small Claims Division of the Superior Court, you have the right to appeal that decision. You can search for San Diego Small Claims Court and you will find the website giving you this information. It appears that it will cost you around $100 (perhaps more if service is required for a summons) to file this appeal. It is very important to note that on appeal, EITHER party MAY be represented by an attorney, this is a fairly significant change from the original case.

From the SD Courts website in regards to appeal:

* Only the defendant, or plaintiff on a defendant's claim, has a right to appeal. The appeal must be filed within 30 days from the date of the mailing of the entry of judgment. An appeal is a new hearing that includes the claims of all parties to the case. To file an appeal, fill out the NOTICE OF APPEAL form and pay the correct fees. The appeal will be scheduled and all parties will be notified by mail of the appeal hearing date.
* A small claims appeal is called a TRIAL DE NOVO. A de novo hearing means the appeal court will hear the case without regard to what happened at the first hearing. An attorney may represent any party at the appeal hearing. Judgment on appeal is final.

You should work with a friend or someone to help get your facts organized and clearly written. (While I'm sure that you were not looking to present your post on this website to a court, your posting has room to be more clear). I think you should be very cautious of making "rude" comments about the judge, or anyone else, such as you do in your posting here. Not that I know of any "legal" issue with it, you simply want to maintain a high level of credibility, and making rude comments will not accomplish that.

The Small Claims Division has legal advice available, I believe at no cost. I think you will get better service if you go into the Kearney Mesa offices to use this service, but they may be able to help by phone. Check the Courts website for info.

As you should have learned prior to going into court initially, you must have a copy of everything that you plan to present as evidence to give to the judge. You will want to have copies to present at an appeal as well. Read-up thoroughly on the process at the Courts website. There is a process that WILL be followed. For the most part, even in small claims, you don't get to simply speak up at any moment that you wish. You need to be familiar with how the process works and there is a lot of information on the Internet that deals with it.
