Savings And Recovery, LLC Should have known it was a scam! San Juan Capistrano, California

I was weary when the sales rep approached me with his proposal.  I had heard of these service before and actually heard good results.  I did my research but unfortunatly, a year and half ago there wasnt any negative on the company.  Boy has that changed!  Being a medium sized business, the rep informed me he could most likely save me $10,000 a year in service, needed 50% retainer up front.  Stupid me, gave them a check for $4762! 

We began sending them our utility bills and then about 6 months in we get a letter that we have voided our contract for not sending them all the required information.  I tried to call them but they absolutly REFUSE to speak to anyone.  Must write them.  After a dozen emails with no response I finaly found out I had failed to complete some utilities usage report which was absolutly stupid.  I completed the report for them and they agreed to "extend" our audit 6 months. 

February marked the end of our audit.  Heard nothing from them so I emailed them.  Finally got a response that I should expect the results in a couple weeks.  Five weeks later nothing.  I email them again and get a response from the owner that should have the report a week later.  Yesterday received a ZERO balance invoice stating the following...

"Your audit has ended. Attached is the UCA (utilities usage comparison/analysis reports) 15% or greater has been attaned on one or more utilities and or one or more mnonths during the audit year under, cpu, units or dollars.  The fee is charged when attainable.  Our Guarantee is 15% fot he cost as stated on the Purchase Order.  The cost on any Utility Bill is based on three factors, Units, Dollars and Cost per used Unit-CPU, Savings and Recovery has earned the retainer per the contract.  No balance is owed..."

My utility bills actually dropped 5% but this was not by any action by this company.  We just experienced a very mild summer and winter which resulted in less energy usage!  No where on the paper work did it state "15% or greater has been attaned on one or more utilities and or one or more months during the audit year under, cpu, units or dollars.  The fee is charged when attainable."  The order reads, "S&R GUARANTEES THAT THEIR AUDIT WILL ATTAIN A MINIMUM 15% REDUCTION OF YOUR UTILITIES COSTS OR THERE WILL BE NO CHARGE TO YOU" 

I have written the owner of the company a letter and spelled out the multiple failures by his company and the fact that the company didnt complete and training or rate reductions as was spelled out by the agreement.  I have requested a full refund but I doubt I will hear anything back. 

This company banks on the majority of businesses forgeting about the entire program or failing to send a months utilities bills or some document.  When this happens the extend the audit, giving more time for the company to make a mistake and voiding the contract. 

CALL THE POLICE IF THESE PEOPLE WALK IN YOUR DOOR!  RUN AWAY!
