 my name is david baird. i have had a mtg loan with saxon mtg serv for over 10 yrs. in the last 18 mos i have applied for a loan modification to lower apr 4 times. i am a retired banker and pointed out the original loan documents did not include a right of recission, which is a federal violation in the process of making the loan. i have been told after filling out loan modifications saxon never recd them. i spoke with a manager and explained my situation and that i had not been given the opportunity to sign a right of recission. my loan was moved to ocwen loan servicing, llc. now  i have to start the process all over again. failure to give a right of recission can cause lender to forfeit all prin and int pd. there it is guys. sick em.

Saxon HAMP RipOff

Re: HAMP with Saxon mortgage = DELAY.

I have one piece of advice for you.  RUN, don't WALK.  We, also, had the identical issue with Saxon Mortgage.  We owned our home for 16 years.  After about 13 years, we refinanced our home so that we could afford education for our children.  Not long afterwards, my husband lost his job (primary source of income for the household), and we were contacted by Saxon Mortgage to "refinance" under the new HAMP program.

We qualified, made the "trial payments", and then were told that we'd "have to hold on" because Saxon didn't have the process in place quite yet. So, we were put on the "temporary payment plan", and were told that  all of the payments that we were paying would be applied appropriately and no late payments would be reflected on our mortgage (since the HAMP trial payments were less than the original mortgage payment)..  So, we did just that. We continued to pay on our home as agreed upon.

At the end of each "trial period", we were told that same information once again. Patiently, believing that we were in (and had been told that we were, as well as recieving paperwork to confirm that we were) the HAMP program, we waited. We paid. We were patient.

Silly us. Reality set in when we received the FIRST notice (about 6 months into the program) stating that our home would be foreclosed upon.  Immediately, we called. We were advised that this mailing was inaccurate, and many had been sent out by mistake. A "glitch" in the HAMP system,  since the program was so new.  Then we were told, "keep sending the regular agreement amount due, and it will all catch up once the system is working properly"....Well, about 8 months later, after making our payments on time, as agreed upon, we received the SECOND notice.  Again, having made the payments, having the receipts, having the signed documents, we called AGAIN.  And AGAIN, we were told, NO, our mortgage is just FINE. It's simply a paperwork 'GLITCH'.

Fast forward to 23 months.  We come home to a notice taped to our garage, a certified letter, and a copy of the letter in our mailbox.  Our home was up for auction in less than 20 days.

This time, we are told, that all of the "payments" that we had been making under the supposed HAMP program, had been put towards the regular mortgage amount, and even though the HAMP was in place (?), the traditional mortgage was running concurrently, and was so delinquent, that the home was to be foreclosed upon.   At that point, we had to decide.  Did we stay in the home that we built 15 years prior, brought 3 children home to, invested our life savings in with the fear that at any given time, we would be locked out of our home and homeless...OR  pack up and secure a place of residence for our children.

Of course, we chose the second out of survival alone.  We consulted our attorney, and was advised of our options, including foreclosure.  Council , while intimidated by taking on the government over the HAMP program, made us realize that this scam was going to cost us our home whether we stuck with their game or not.

So, we moved.  Disrupted our kids, disrupted their schools, disrupted our lives.  So much stress was caused, that the icing on the cake was me sustaining a heart attack.

At the age of 43, with NO health issues, and having been to my primary care physician just two days before, sustained a cardiovascular event and endured 56 minutes of CPR.

I whole heartedly believe that the stress of the Saxon Mortgage Scam and Debacle is directly responsible for this.

However, since they won't own up for stealing our money and our home, who's to believe that they would own up for the stress and suffering damage that they have caused.

So, take it from me.  RUN, don't WALK.  It's not worth the heart attack.  It's brick and mortar. It can be replaced. YOU CAN'T.
