My fiance and I have worked very hard our whole lives, and had finally saved up enough money to get a decent down payment on a house (along with some help from my Mom!).  We decided to purchase a brand new home in Port Dover, Ontario, and after looking at a few different styles of homes in the area and the quality of them, we decided to go with JoLynn Construction.

We closed the deal on our house on March 31st, 2010, and we were so very excited to be purchasing and being able to have a choice on what our new home was going to look like!!

We went out the next week and started picking out all of our selections....  We picked out brick, and flooring (Apr 6th 2010) this week.  We talked to Shane Walters at Simpons Great Floors in Brantford, Ontario, and told him we were having a house built with JoLynn Construction, and we wanted to pick out some flooring.  We asked him about laminate, and ceramic tiles.  We picked out laminate from a selection of about 6 - 10 different laminates that were all $1.99 per sq ft stuff that was, according to Mr Walters, equivalent in cost to carpet.  We then picked out some tiles, we picked bigger tiles, 18"x18", which he told us, were the same price to install as 12" tiles.  So we filled out our selection sheet, got our copy, and left with smiles on our faces because we were one step closer to our new home!

Over the next month we got all of our selections picked out, and started watching our house being built.  I've documented the entire process on facebook, uploading pictures of our selections the day we picked them out, the ground breaking of the lot, pouring of the footing, foundation, walls up, etc...

We closed our house on June 30th, 2010.  Without a kitchen, since the kitchen place we decided to choose went out of business apparently 2 weeks before closing.  So we had a temporary countertop on 2x4's with sinks in the kitchen and bathroom until our cabinets and real countertops got installed two months later, that's another story.

On July 5th, I emailed Shane Walters at Simpsons Flooring and asked him about grout and tile sealer.  He replied with you only need to seal the grout, we sell it here or you can buy it at home depot, oh also you will need to pay us for those laminate floors.  I replied, What are you talking about??  That wasn't supposed to be an upgrade and I never even knew it cost more!  He replied with an email saying "see I told you this would happen (it was addressed to our builder as well), and said he would have to bring it to court".

Then, August 19th, 49 days after closing, we received the first invoice regarding an extra cost associated with upgrading the laminate floors.  This was the first time any official notice was sent to us.  I replied with a letter saying I didn't owe them any money because I never agreed that these floors were going to cost more, I never signed anything saying it was going to cost more, and on top of that, the house is already closed and we are moved in and just now you are telling me I owe you money I never agreed to even pay you?  Then, today, October 18th, I got a letter from a lawyer in Brantford Ontario, saying they will pursue legal proceedings within 10 days if I don't pay them, and that they are confident they can win in court, and that I'll have to pay all of their clients legal fees!

How can someone charge you for something that you never agreed to pay for?  This is the exact same as a mechanic doing work on your car, and fixing more than they should have, then charging you for it over and above what you agreed to pay for.  They can't sue you for the work after, and I don't see how this situation could be any different.  We were never once told this was an extra cost before closing, if we had been told it was going to be an extra $2500 for 800 sq ft of laminate I would have told them were to put the laminate (back on their shelves!!).

As the owner of Simpson's Great Floors I would like to respond to the allegation of my store scamming customers.
 
Simpson's Great Floors is a family owned company that was started by my father and has been installing quality floors for over 34 years. My family and our employee's take customer service and our reputation very seriously. Our business survives on customer praise and referrals. We want ALL our customers to be so satisfied with their flooring purchase that it is the only flooring store they would send their family and friends. I can assure you there is no way in this world that I would put 34 years of hard work and credibility in jeopardy to scam a customer.

What this customer fails to point out in his complaint is that he mislead our employee Shane Walters into thinking that his contract with Jo Lynn Construction included ceramic tile and laminate flooring. This type of flooring is normally an upgrade to a standard flooring allowance. He explained to Shane when he came into make his flooring selections that the upgrade for laminate and ceramic would be paid by the builder Jo Lynn Construction and that it was in his offer to purchase.  This is a fairly common practice so that major upgrades can be incorporated into the mortgage at the time of closing.  

It wasn't until the bill for the upgrade was sent to the builder that our company was made aware that the customer had misrepresented his offer of purchase and that the upgraded flooring was not in his contract.

Assuming that it could have been an over sight or a misunderstanding between the customer and the builder Shane called the customer and politely explained the situation. It was then that we saw the true colours of the customer when we were rudely told "to bad so sad, it wasn't my mistake and I am not paying for any of the upgrade".  Most fair and honest people in a situation like this would be a little more understanding. They would take the time to reread their contract with their builder. Once they found out that the flooring they actually recieved was an a upgrade, maybe make some type of effort to pay for at least a small portion of the upgrade.

The bottom line of this unfortunate situation is that our company does take full responsibility for the loss. Because we did not confirm with the builder or ask to see a copy of the contract from the customer we are writing off the $2,500 invoice and no legal action was ever taken.  It is just to bad that the good old days of honesty and a hand shake have to be replaced with skepticism and paperwork.
