Sleep Train Mattress Delivered defective $3000 mattress and won't replace Encinitas, California

Purchased a Simmons $3000 mattress set from Sleep Train Encinitas.  When it was delivered we noticed that the pillow top was very very lumpy and a complete mess.  I actually thought there was a pillow section that went by your head, which there should not be, as the delivery man told me that it was the end of the bed.

Called the company and they sent there driver back to take a look.  He walked in and said it was a mess and to call the company back for an exchange.  They were now going to send out an "independent" company to take a look.  What was the point of the first guy coming out if they were not going to act on his recommendation?

The next guy comes out and does measurements that were meant for a concave, dented mattress which did not really show the matted sections.  He took the bed off to check the box spring, then put it back on and saw how bad it really was.  He stated that he thought it looked like the Grand Canyon.

Late Sunday night I get a call from Sleep Train Customer Service telling me that they are doing nothing and the mattress does not fall under the warranty guidelines.  Basically I am out of luck and that maybe in time the mattress will "settle".  

Can't believe there response.  I do remember being in the store and hearing over and over again from the salesman about the satisfaction guarantee.....................................Can't believe I have to spend my time chasing this down.  A $3000 mattress and this is what I get????
