Made a payment of 4 months for 2 gym membership and the place closed out.

Snap Fitness in New London never informed the location was being closed. The staff was always complaining they were not being paid by the owner, which is not of our concern since the paper towel dispensers were always full, the bathrooms were cleaned, and cleaning solution bottles were being refilled

 

Suddenly there was no more staff available to renew our membership, and corporate office never responded to our emails requesting any information of how to make the payment.

 

We were told by the location in Waupaca - WI - 40 miles away from the location in New London - that we could make the payment there and use New London with no problems.

We paid Waupaca $180.00 and the location in New London closed out. The place was empty, machines were gone, the place was completely empty.

After sending many emails to corporate office; The owner in New London claimed he would not reimburse our money because is a franchise and he didn't received our payment, claiming NL was closed for a very long time, when in fact was open, not only for us, but for many other members using the machines every time we were there. He claimed the swipe cards at the doors should not be working because it was closed, but they were, because when our membership expired our cards stoped working, when we renewed in Waupaca, our cards started working again at the door.

 

I told corporate office, is not my problem if Snap Fitness is a franchise and private owned. I made the payment to Snap Fitness - who carry their name or who buys their franchise is their problem, not mine.

My membership agreement has Snap Fitness name on it, and I wanted my money back, doesn't matter where was coming from.

After 3 months I still don't have it!

 Sorry but it was a franchise and as such the franchise would be who you would get a refund from. Its unfortunate that this has happend to you, but the main corporation wouldnt have seen ANY of your payment. I know you THINK its not your problem but it really is. Even in a court of law, there is a major difference between a corporate store and a franchise. Yes it may be the name of the corporate company, but its just that A NAME. The franchise owner is RENTING the use of the NAME for business purposes. The franchise owner gets the brand recognition and fame of the name but none of the corporate support. The owner would pay for the rights to use the name and likeness.

It would be like say your renting an apartment and someone came and served you with legal papers that YOU owe the property taxes. Yes you DO live there, but its just not YOUR responsability. Same thing applys here. You wont be getting ANY money from the corporation, its just NOT going to happen. THEY are not LEGALLY responsable for the actions and descions of the franchise.

Best bet is to TRY and take them to small claims court, but thats more time and money. And legally speaking you may have paid for the MEMBERSHIP, but if your name isnt on the membership then any money collected would go to the person who holds the membership.

Good luck in your fight, I would suggest looking up the owner in your states business database. Atleast then you would be able to start the process of getting something back. You start with a registered letter and go from there.
