I closed on my loan on July 31, 2008. I signed documents that were blank since it was month end. We needed to get the documents completed to stop the down payment funds from accruing. I was also trying to be nice to allow Cindy to get her bonus due to the end of the month. I told Cindy and Macy to get the documents completed and call me when they were ready. They knew that I was coming back to initial all the changes that needed to be made to complete the documents. There was one piece of paper that had handwriting on it and I initialed everywhere that there was handwriting. I have been calling ever since to get copies of my documents. Every time I called I was told that they would get them for me or they would leave a message for Cindy. I finally received documents a couple of weeks ago from the office. When I got them they did not appear to be all of them. I then called the bank and asked them to send me what they had. After receiving these documents I realized that the documents had been altered by being completed without my initials. I immediately called the office and the bank and let them know that the documents were altered after signing. The Park Office then gave me another set of documents which had more included on July 30, 2009.


As I have explained to Macy, the mold was not taken care of as agreed. They sprayed the walls with bleach stating that it was mildew and not mold and that the bleach would take care of it. My dog managed to put a hole in the wall and the mold is coming out to the carpet as well. I have taken pictures of the two places in the house as well as the outside which is where I believe the issue starts. I also explained to Macy that part of my purchase agreement was a sidewalk where the 6-7 foot dirt place is.  I have waited since I moved in 2 years ago for this to be done. I was told that it was delayed during the sale of the park. I was then told that it would be done when they repaired the streets. They did that and it still didnt get completed. I have waited long enough for this to be done. I have called the office and asked multiple times to find out when it would be completed and every time I was told a future time it would take place. When I spoke with Macy at the end of July she stated that they found the order in my loan file and she turned it in to be completed. They finally put in the sidewalk on Friday September 11, 2009. I took pictures while they were doing the work.


I asked for the park as part of my contract to repair the sink and toilet in the master bathroom. That did not get that completed either. The sink can hardly be turned to get the water off and on. The toilet has been running since before I did the purchase. It is continually getting worse. I have asked Macy to correct this error since the loan was fraudulently completed by altering the documents after I signed without giving me copies as well as getting me to initial any changes that were done to the documents. Especially since I requested to be called in order to complete this process I find it as fraudulent. I have never heard of it taking a year to get someone copies of their loan documents. I have made my payments every month up until the month of July at which point I was getting completely frustrated. Macy has offered to come in and make the repairs that are needed. I have refused at this time for her to do this. I work during the day for one and I do NOT trust them to be in my house. Secondly, though I do not feel that a year later should qualify as correcting a breach of contract. They did not complete their end of the contract in more ways than one.


I have asked Macy to purchase the house back and do as they please with it. She says that the only thing that she can do is sale the house for me which would give them another bonus for brokering the loan. It would also require me to allow them total access to my house to show and repair it while I am not present. I have spoke to Janice and Sandy at Clayton Bank & Trust. They have told me that they will allow an assumption as long as I find a buyer for the house. Sandy has also told me that the matter has been escalated to the VP for review. I am in the hopes that he will come back with a solution. The VP who reviewed the complaint was Donna someone that worked for yescommunities which stated that they did nothing wrong by altering the documents. They had every right to alter the documents and that i had no case against them. I really do not want to have to sue to get this taken care of. It would be a waste of time for all involved. I have told the bank as well as the park that I would be more than happy to walk away from the property if they will just give me the money that I put down back ($8,820.00 approx). I have also told them that it was not fair for me to not get my deposit back when they screwed up the loan to begin with. I do have to have some money to move somewhere else. I have paid including lot rent $832 a month for the last year. The year and a half prior I was paying $650 approx. I can not remember at the moment. I am not asking for everything back. 


After the above was given to everyone involved, Macy has sense come back and said that there is no reason for me to sue cause they always win. She then told me to fill out a loan application to move three payments to the end of the loan to give them time to sell the house. She told me to forge the loan documents and put my past employment and income on the loan application and turn it in. She stated that the bank does what they tell them to do and that she would get them to accept my loan application with forged information on it. They did come in and put in the side walk on Friday which is cracked all the way across it. There are ants living in the attic still which last time they did actually repair that the ants were in the mold in the house.


They evicted some folks across the way and I knew about the eviction before they did. I have also been told by Macy about three other evictions that are taking place. is this not private information or is it community knowledge that is allowed to be told to just everyone that walks in the door.


They lie and get away with it constantly. I used to like this place but the longer I am here the more I find out. I have also found out from other people that used to live here that this is the norm and why they left as well. They are nice to your face and tell you what you want to hear and then once you are gone immediately forget or ignore your complaint. Nothing gets taken care of as agreed.

YES! Communities prides itself on providing excellent customer service and partaking in nothing but honest transactions. We wish this complaint had contacted us directly so that we could have looked into their concerns and corrected them immediately. That being said YES! Communities would never make changes to documentation without the legal right; all parties involved always initial all changes made on signed documents. Southfork’s long-time maintenance staff has always been diligent in their efforts to correct any issues reported by residents or new homeowners within the community; unfortunately, we come across cases where some residents are never satisfied though we continue to try to appease their needs. Lastly, YES! Communities nor employees of YES! would condone or encourage falsifying information on any paperwork. We encourage all residents to reach out to their community management or the home office customer service at YESICanHelp@yescommunities.com with any concerns immediately so that we can address these concerns and correct them.
