My husband myself and our 5 children were planning to build our dream log home. This had been a labor of love for many years. We found the land , had the plans drawn, and had all the financing in place.
We began getting bids and were quite excited about the bid and promises we recieved from Southland Log Homes. We were working with the local office just outside of Nashville. I , fortunately, had the salesperson and the local sales manager write out the prelimanary bid on SLH (Southland Log Homes) letter head.
Southland had a local builder, Cliff Jones, contact me to secure the dry in cost. We were told that we would need to send in aproximately $15,000 with our contract and give the builder $5,000 to secure our bids. We wrote the checks and began celebrating the begining of what we thought was our dream. Ha Ha!
My Sales person, Jack Fanning, sent in only a portion of the contract. What he told me was part of the contract, he sent to the company as a change order, as if it were additions rather than what he had told me was inclusive of the contract. Obviously the company wanted to charge a great deal more.
Once again I had fortunately dated and copied all the parts of the contract. With the same date on all papers it was quite obvious that we had been mislead. The Vice President of the company came in to meet with me and gladly promised to returne my deposit, hoping to avoid a law suit, or doing what was promised . He also promised to encourage the builder to refund the deposit and all agreed that they were not legally, but morally and professionally responsible to help get this back.
I Did get the SLH deposit back, weeks later than promised, but I did get it. I still have not gotten the deposit from the builder back, $5000, and of course he has changed his phone number. All my requests for help from SLH have fallen on deaf ears.
We are now moving on with a more reputable helpful company. I wanted to share this and hope that no one else has to go through what our family has.

At the time that Mrs. Bergholtz first approached me at Southland I had about one month in at the job. The Original way that we made first contact was YOU calling me to ask if we could beat daniel boone quote. We at southland crushed Daniel Boone's quote with far superior materials and met your request.I relied heavily on the assistance of the Managing partner, Kevin Hicks, which did almost all of the negotiations on the product. You tried everything that you could to take advantage of my situation, with no prior experience in the log home market or any other residential construction industry. I have noticed that his name has been ommited from the above mentioned complaint. Kevin Hicks told me to send in the change order a day after so it would have a better chance to get approved. YOU were completely aware of what we were doing, regardless of if you admit it or not!
First and formost Kathy, the changes that were made at you property in brentwood TN were made on site and those changes included a $17000 Garage, log siding for the entire home (including closets and nooks and crannys). I asked repetedly for you to wait untill I could contact a contractor that could give us exact numbers.But you insisted that you knew the right number and how to measure the footage needed. You guessed at the price of the log siding for the exterior and interior of the home. The total of the log siding alone (39,500 linear feet) @ $2.35 per linear foot, was the actual price. You estimated a much lower figure, both in linear foot and price.
To make a long story short, I spent a month creating 3 seperate proposals because YOU changed your ideas once a week. I also have all the paperwork associated with all the contracts and the form you are refering to has a huge TITLE THAT SAYS "MATERIALS CHANGE ORDER". So in fact, you knew that this was a change order.
Kathy, I helped you the best I could. I called the contractor 10+ times.... have cell records to prove.
The moral of the story here is, there is no free lunch. If you went to the grocery store and bought a gallon of milk, you are not entitled to get 10 t-bone steaks free! You have the letters that have been sent to you, i intend to follow through by the date on the most recent letter. We spent 5 hours going over details at your home and you agreed to the price indicated by your signatures on the contracts. You and your husband own a business.... www.takes2fitness.com, please dont tell me that you do not read contracts. you were trying to take advantage of a situation and then cried when you did not get your way. My name or southlands name included in this Report are slander, and will be handled in that way. Please renounce your above statements.
Please remember I have the items to prove that this is slander, and will protect my rights vigorously. Please Kathy.... lets not do this.
