On 4/2/2005 I saw an advertisement in a local newspaper(Staten Island Advance) from Staten Island Nissan dealership for 2005 Nissan Murano SL AWD listing the following lease conditions: $0 down payment, $0 bank fee, $0 1st month payment, $0 security deposit, just pay tax, tags & registration fees, gap insurance included, $319.00 per month for 42 month.

I telephoned the dealership to verify this information, which they promptly did and assured me that they have hundreds of these vehicles in-stock. My wife and I then proceeded to go to the dealership to lease the car. Upon arriving, we were met by a salesman Sam Makso, with whom I spoke on the phone.

I asked to test drive the vehicle, but was told that the dealer does not keep their cars on premises and all their cars are located on their lot in Brooklyn. I was offered to test drive another car that they had there for this purpose. After the test drive we proceeded to pick the color and options.

In the end we chose the car dealer claimed to have in-stock with the following VIN#: JN8AZ08W75W417532. After some negotiations, the dealer agreed to wave the $540.00 Destination Charge and $198.00 Prep Fee, which was listed on the sales slip. The dealer agreed to deliver the car on 4/7/2005 and required me to pay a refundable deposit of $198.00, which would cover the Doc Fee the dealer charges. I put that charge on my credit card.

I was also told that I would need to bring proof of insurance with $100/300K liability limits and deductible not to exceed $250.00, listing HANN FINANCIAL SERVICES P.O. Box 4658 TIMONIUM, MD 21094 as the leasing Lienholder.

When I arrived at the dealership on 4/7/2005 to pick up my car, I was met by Sam Makso, who directed me to meet with their Finance Manager. I believe his name is Nabil Sageh. Nabil told me that he wanted to offer me another leasing option. He said that Hann Financial Services was not a good leasing company.

They require a disposition fee at the end of the lease(this was not mentioned in the ad or my initial conversation with the salesman), that they require the car to be returned in perfect condition, not allowing for normal wear and tear, that they charge $.20 per mile above 10K per year limit, and many other negative aspects of this lease including higher auto insurance premiums I would have to pay due to $250.00 deductible requirement.

I was then offered to consider a lease with NISSAN, which would cost me over $420.00 per month with tax, but was supposed to be a better deal overall. I declined his offer, telling him that I would like to keep our original agreement, but before I sign any papers, I need to see the lease agreement form to verify all information.

Nabil told me that he did not have the lease agreement in his office (finance manager's office), and he went out apparently to look for it. While Nabil was out of his office, another sales manager came in. his name is Joe DeFeo. Joe started to tell me exactly the same story about leasing company that I just heard from Nabil.

I politely asked him to stop, since I have already heard this and asked him to produce a copy of lease agreement for my examination. Joe told me that he cannot show me the lease agreement due to the fact that it was an E-Lease. I asked him to print a copy of the lease, which he refused to do.

At this time I realized that this dealer has no intention of honoring our agreement and that I was a victim of bait and switch con. I asked Joe to refund me the $198.00 deposit. Joe left the office and came back a few minutes later, stating that he would refund my deposit only if I gave him the original sales agreement.

I said that I will not return it since I intend to take this sales agreement to local authorities to file a complaint. Joe became irate, yelling at me that this agreement does not mean anything since his signature was not on it, and that he knows how to run his business, meaning how to swindle people. At this point I told him that I would contact my credit card company to dispute the charges and left the dealership.

To date I filed a complaint with Attorney General and contacted Nissan Corporation. I will also contact Better Business Bureau, Department of Consumer Affairs and mass media.

Hey Alex I called this sucky car dealer and they have some BIMBO awnsering the phone. Seems like she has been programed to keep all upset people far away from anybody in management. I am willing to bet that your Attorney General has many complaints on this Nissan dealer.

As far as them trying to get you to sign a deal that is like this below, that would be a bad deal for you, $.20 per mile over the limit, most can do $.10 to 15. Normal yearly milage today 15,000 to 20,000

DUDE they would be giving you the big HIGH HARD ONE in a car deal like that. F&I manager just felt that they did not go deep enough on the first car deal and wanted you to come back to the scene of the slime and let them go GO DEEPER.

As far as this below, sounds like they tryed to double team you

Nabil told you that he did not have the origanal lease agreement because he did not want you to see HOW MUCH DEEPER they had plans to go with a new contract. I am now giving you some good helpful info. I want you to contact your AG's office and print off a copy of your Rip Off Report and give it to them.

Alex you need to go to this below web site and look for one of the AG's office that is close to you. Bring them a copy of your Rip Off Report. This car dealer needs to have it's a*s KICKED. I will help you anyway I can.

Also I called your SUCKY car dealer and got some other CLOWN who did not want me to talk to his GM. Sounds like they keep unhappy car buyers FAR away from the managers.

I also would contact Nissan Motor Crop and tell them to look DEEP into this dealers CSI numbers. I am willing to bet that many new car buyers that are unhappy never get a CSI survey. Tell Nissan that you think that this car dealer might be doing "CSI Diversion". That will soil the manager's morning newspaper!

Promote "$0 Down payment" that misleads consumers into believing they can complete the purchase/lease of a vehicle without paying-out any money. Consumers later learn that registration fees, taxes and other charges must be paid when the contract is signed;

Advertise "0% APR" that fails to disclose conditions, qualifications and limitations that materially affect the offer's availability and violates the federal Truth-In-Lending law;

Advertise low monthly lease payments in violation of federal advertising laws that require the disclosure of information about other costs that would significantly increase the total cost of leasing; and

Promote "Bad Credit? No Problem!" ads that mislead consumers into believing that they can receive financing regardless of their credit history and fails to disclose that the finance rates for high risk borrowers may be prohibitively high.

Deceptive advertising which prominently displayed "$0 down payment" with significantly smaller print indicating such information as the total amount due at lease signing;

Failure to state the total amount due at lease inception;

Failure to state whether or not a security deposit is required; and
inadequate disclosure of important qualifications necessary to lease a car through a rebate offer or at a stated annual percentage rate.

Prominently displaying favorable down payments, for example "Just $89 Down Delivers," but failing to disclose other credit terms as required by federal regulations;

Announcing "Absolutely no credit applications will be refused," which could mislead consumers into believing that everyone would receive financing regardless of credit history;

Falsely implying that a certification office of a prominent firm had selected Royal Auto to conduct a huge factory liquidation sale, when such was not the case;

Claiming "$1,000 Below Dealer Cost," a deceptive comparison between a vehicle sale price to the purported dealer "invoice" price. The Attorney General's guidelines consider this representation to be misleading because the invoice price does not accurately reflect the dealer's ultimate cost; and

Using phrases such as "Up to $4,000 Off," which failed to disclose the basis for the price comparison.

Alex many car dealers love to play Rip Off Games. They love to take advantage of car buyers every chance they get. The ones that really get pissed off are the ones that know they have rip Off Reports.

It is a shame I can't find attorney Generals like Eliot. Eliot has the balls to spank dirty car dealers. Maybe one day I can say the same about other AG's in this counrty. Below is proof that New York's AG kicks a*s.

Here is a small list of games they played!

Promote the lowest prices in ads, without disclosing (or doing so in extremely fine print) that the advertised price excluded a range of additional fees and charges or applied rebates of very limited availability;

Promote "$0 Down payment" that misleads consumers into believing they can complete the purchase/lease of a vehicle without paying-out any money. Consumers later learn that registration fees, taxes and other charges must be paid when the contract is signed;

Advertise "0% APR" that fails to disclose conditions, qualifications and limitations that materially affect the offer's availability and violates the federal Truth-In-Lending law;

Advertise low monthly lease payments in violation of federal advertising laws that require the disclosure of information about other costs that would significantly increase the total cost of leasing; and

Promote "Bad Credit? No Problem!" ads that mislead consumers into believing that they can receive financing regardless of their credit history and fails to disclose that the finance rates for high risk borrowers may be prohibitively high.

Deceptive advertising which prominently displayed "$0 down payment" with significantly smaller print indicating such information as the total amount due at lease signing;

Failure to state the total amount due at lease inception;

Failure to state whether or not a security deposit is required; and
inadequate disclosure of important qualifications necessary to lease a car through a rebate offer or at a stated annual percentage rate.

Prominently displaying favorable down payments, for example "Just $89 Down Delivers," but failing to disclose other credit terms as required by federal regulations;

Announcing "Absolutely no credit applications will be refused," which could mislead consumers into believing that everyone would receive financing regardless of credit history;

Falsely implying that a certification office of a prominent firm had selected Royal Auto to conduct a huge factory liquidation sale, when such was not the case;

Claiming "$1,000 Below Dealer Cost," a deceptive comparison between a vehicle sale price to the purported dealer "invoice" price. The Attorney General's guidelines consider this representation to be misleading because the invoice price does not accurately reflect the dealer's ultimate cost; and

Using phrases such as "Up to $4,000 Off," which failed to disclose the basis for the price comparison.
