I have read a number of accounts of problems with Subrogation Management Team (SMT). Having been through similar harrassment, I wanted to pass on some advice. I was in an accident with a rental car; my insurance paid for the damage and SMT chased me for loss of use, diminution of value and other fees. The first thing I did was to find out my rights.

I spoke to a lawyer (you can usually find lawyers who volunteer time) who underlined that any additional charges relating to the accident, beyond damage, needed proof. I told SMT to only communicate with me via letter (again legally this is your right). Each letter I then received from SMT I replied to with a certified reply demanding proof of the validity of these charges. No matter how threatening the letters from SMT my response was the same. Eventually, I heard no more from SMT.

Thanks for your advice on how to deal with with Subrogation Management Team. I took your advice when dealing with them. Though never having signed a contract with a rental car company (I was driving my car during the accident with the rental car), I was still chased for bogus charges (loss of use and diminution of value). Similar to your experience, they could provide no proof of the charges validity. Eventually they went away, after many threats. I paid them nothing.

I have read that drivers who have been in accidents while actually driving rental cars are chased for similar fees. Be aware (and I looked at some example court cases); diminution of value can realistically never be proven until the car is sold. Don't accept any amount without proof of how the figure was arrived at (it likely won't stand up in court). For loss of use; all the cars in the fleet need be unavailable for the repair period for this to be valid. The rental car company (or Subrogation Management Team) need to be able to prove this is the case. Remember, your credit cannot be affected without a court order. If you do end up in court a judge will require proof of the validity of these fees (just as you do). All cases are different. But know your rights. These people are out to scare you into paying fees which in many cases are bogus.

GET IT !! SO ITS NOT A RIPOFF, ITS YOUR FAULT FOR NOT READING THE CONTRACT!!
SO THE RENTAL COMPANY GOES AFTER YOU FOR EVERY PENNY THEY HAD TO PAY TO REPAIR THE VEHICLE AND THEY ARE ENTITLED TO!!!!!!!!!!!!!!!!!!!
