At the end of 2009 I received a broucher for a apartment complex named Sun Vista Gardens that was exclaiming that you could purchase a 1 or 2 bedroom apartment for much less that renting.My lease was up in April of 2010 so I decide I would look into purchasing one of their 1 bedroom apartments.When I arrived at the complex I notice large banners on the outer walls promoting a 1 bedroom apartment for $595 a month.I entered the main office and was taken around the grounds by a slick Salesman who seemed more preoccupied with other things going around the complex than addressing my concerns.I felt the apartments were similar to what I was renting now and at half the price plus the advantage of buying over renting.After agreeing that I liked the apartment I was taken back to the office were I was introuduced to a Gentleman from Home Financing Center a mortgage company.I explained to him that I had a bankcruptcy in 2007 that had been discharged.He asked me to supply him with tax returns for the past 2 years and all of the documents need to varify my income,bankruptcy,investments,IRA,etc.This would have been my first time buying a property and the Broker felt I should be able to secure a loan thru Fannie Mae.

I scanned and attached all the docs needed to the Brocker.I was called by the Salesman that I need to come in and sign the purchase agreement while the paperwork for the Broker was going thru.The Salesman for Sun Vista Gardens tried to rush quickly thru the signing.The first thing that thru up red flags to me was that the Purchase Agreement Stated a LEXINGTON ON THE GREEN as the Apartment Complex instead of Sun Vista Gardens.He exclaimed "Oh that was the old properties name and that we are still using the same agreements". The Salesman stated that we need to sign quickly   today so the broker can apply for this loan.I was hurried thru the signing.In the agreement it stated that buyer has fifteen days from the signing to get the deposit back if the loan is not approved.I asked about it and the reply was not to worry you should get the loan by then.I supplied the Broker with everything he need in a timely matter.A week after I had submitted everything the Broker assured me that the loan is looking good ,however he was going to need me to resend everything again because he needed to resend it to his head Broker who submits the loan and that his computer could not send it in the format I sent it to him in.

I ended up printing it all up and driving it to him to get this done quickly.After the 15 day mark of the signing was up I noticed  that the $500  check deposit was cashed.The next day I was given the news that my loan did not go thru due to limited time at my job not because of the bankruptcy.I asked the Broker about the deposit and he told me to talk to the Salesman.I went in on a Saturday afternoon and the Salesman was with another customer and did not even acknowlege me.When I finally talked to him he acted surprise that the loan did not go thru.I asked him about the deposit refund and he stated that you should be able to get it back because the loan did not go thru.I know though he was humoring me because it was a Saturday afternoon with lots of customers around.He told me he would look into it and get back with me on Monday.Of course I never heard back from him and did not return my calls.I feel like this is a scam because I supplied the mortgage broker with everything he needed to send the loan in for approval very quickly.It seemed that he used technical issues with his computer as the reason for not submitting the paperwork quickly.I also feel I signed a purchase agreement for a development other than the one advertised.I hope this is just not another scam to get deposits out of people who believe they are getting a loan thru these characters.
