Like other people looking for products to sell on eBay auctions, I purchased a free eBay cd and a trial drop-ship membership with SurplusAlert.com; little did I know this company does not deliver as promised.
I placed five orders for merchandise to fulfill my customer's orders. After ten days, I begin to get inquiry messages from my customers wanting the merchandise recently purchased.
I contacted Surplus Alert to obtain the shipping information, Shelley Ball reported, the tracking information is not available yet, but we will forward it to you as soon as we get it. It has been 30 days since I placed my first order, I still do not have any proof of delivery for any of the five items ordered from SurplusAlert.com
I sent a demand for the tracking information to customer service, and a notice of cancellation regarding my account. Customer service referred me back to Shelley for the tracking information. Until I filed a complaint with the Utah State division of Consumer Protection, no attention to my recent orders was given any consideration.
Utah consumer protection closed my complaint, as Surplus alert is not in violation of the Utah Consumer Sales Practices Act this is only in effect between supplier and consumer transactions, not business-to-business transactions. I am advised to pursue a complaint with a mediator like the Better Business Bureau (BBB) and seek actions in small claims court or retain private council to sue in civil court.
Just like some of the other complaints, I discovered a charge of 49.97 on my credit card statement two days after my trial membership begin with Surplus Alert. I do not know who authorized this charge, but I am in the process of disputing the charges along with the money I paid for the merchandise, which never shipped, to my customers.
Fortunately, I paid for four of the five items using PayPal; this makes it much easier to mediate the proof of delivery. I believe PayPal will reverse the charges as soon as the delivery proof is not provided for this merchandise. I was required to refund all of my customer's payments for non delivery of goods purchased now I am out $320.00 in refunds.
During the past few months, I have discovered most of the internet scams are based out of Utah due to their weak consumer protection laws. The Mormon Way in Utah makes it easier for businesses to rip-off consumers. The Mormon way is an ongoing practice of corporate deception which begin within the Temple of the Later Days Saints, we will do you wrong all week for our own personal gain, and then on Sunday we will shake your hand to make it all better.
As a result of my complaint with Consumer Protection, I was given the name of a contact at Surplus Alert to address my future concerns. Anyone with similar issues should submit their correspondence to Mr. Jay McDonald of Surplus Alert.
