My husband and I pre-paid for daycare on the 1st of the month then found out she was sometimes leaving my 18 month old baby with her 16 year old daughter and sometimes having her 16 year old daughter drive my 6 year old to school. I gave 2 weeks notice and was owed 3 weeks of care between what I had left of that month and the pre-paid deposit (which you lose only if you don't give notice) I took her to small claims court and won a judgement againest her but she never paid it.

I appreciate your comments and I'm not surprised at all that she just "doesn't get it" she will probably be a spoiled brat who lives off her mother forever. She only lives to talk bad about the boy who dumped her-the cell is attached to her hand at all times and my 6 year old was picking up on her bad attitude and language. I'm lucky to have my children out of that daycare and the money part was mostly to show them that they can't do that to people. I did in fact get my court costs too! Thanks again for all of your comments and you are absolutely correct!

Glad you got the refund

Julia - I'm glad you finally received a refund.

I'm a self-employed computer consultant and folks such as Heather and her mom give the me and other small businesses us a bad name.

Heather just doesn't get it. For me the issue was they not giving you the refund - not whether she can babysit and drive. She missed the point of your report which was that they were keeping monies of which they were not entitled.

Heather would do well by going back to school and taking a basic course in contract law. I know of no U.S. court that will allow any business to keep monies for services NOT provided - doesn't matter what the contract says, the court will void the part of the contract that may imply 'all payments are not refundable."

She and her mother made a deliberate attempt to keep your money even though they didn't earn it, and even though you complied with thier "due notice" clause for cancelling the contract.

You were more gracious than I. I would have tacked on the filing fees as well (this is permissible in Erie County) once I filled - now way would I have absorbed the small claims court filing fees.

Little Tootsies Daycare

Heather may very well have gotten on the license since the incidents last year, but at the time she was driving my 5 year old to school and being left alone with my 16 month old baby she was not 19 or even 18 and she was not allowed according to the DSHS Daycare monitor.

I did finally get paid, but not until after I filed on her a second time. I then dropped it after finally receiving a check in the mail. Fact is she has had alot of valid complaints through DSHS and she probably lost her license since many were repeat offenses. Call her monitor if you don't believe what you read here.

This report should stay, simply for the fact that the client had to go to court (and won) to get a refund for services NOT rendered.

I know of NO COURT that will allow a service provider to keep funds for services not rendered, with the exception of a "cancel with due notice" clause which the client in this case complied with.

This is why the small claims court ordered a refund. The fact that the day care wouldn't refund monies paid (in advance) for services not rendered is justification of this report.

Perhaps you should stick to babysitting and driving, rather than trying to justify you mother's attempt to keep monies she was not entitled to.

Rather than immediately refund the advanced monies, your mother forced the client to pursue judicial action to obtain the refund. This speaks volumes about your day care "business" and your attitude towards your clients. If my child was in your care, I certainly would find another care provider who is more appreciative of my patronage and with a higher character than you and your mother have shown.

Julia's post about Little Tootsies Childcare was actually false.

I am the daughter she spoke of, I am 19 years old, I am on the daycare's license, I am legally allowed to babysit children, and drive children to and from school.

Also, my mother (the owner), paid the amount within the time the court allowed. Lastly, in a signed contract it says that all payments were non-refundable. So Julia's post against Little Tootsies Childcare should be deleted promptly!
