On July 4th I went into a Taylor Morrison building site in Avondale, AZ to find a new home.  I went in the next day to put a 1000.00 deposit on a home that would be completed by September 18th.  All along I was told everything was fine.


Later in August, I needed to get a good faith estimate and when I went to their corporate office in Scottsdale, I was given different numbers than first told.  I was also discouraged from buying down my interest rate.  All along I was told these changes were due to recent changes in federal laws on FHA loans or mandates by the underwriter.


I was told my walk through could not be done until September 29th and that I had to take a day off work.  They guaranteed me that since I needed to do that, I could sign papers on the same day.  After the walk through, no one would return my calls and tell me where to sign papers.  On the next day, I was called at 7:00pm and told there were problems and that I did not qualify.  I went through many hoops and had to receive donations in order to give them what they wanted for me to qualify.  Later I found out none of this was necessary.


I was promised things in the home and later told the company would not let me have them.  My broker blamed his boss, the underwriter and then the federal government.


I was told I did not qualify on September 30th and on October 2nd I went looking again, this time with another company.  While in this office, another Taylor Morrison broker came in and recognized me.  He said he would tell my broker I was coming for my deposit later that day.  Not more than 10 minutes later, a Taylor Morrison rep. called me and said I was now qualified and just needed to give an additional bank statement.  They already had a recent bank statement from three days before.


I went to my broker and explained I needed my deposit back.  He refused and would not admit that I was told I did not qualify.  He did say he was not showing it to others that were interested in the home.  Now he told me everything I wanted was suddenly in the house.  I told him, I was told I did not qualify and that is why and when I went looking elsewhere.  Throughout the day I received calls from him still trying to get me to take the house.  He kept saying one thing or another and that it was not his fault the government just changed FHA laws that week.  This was not true.


Now I wanted to speak to a manager and was given a name and number.  I tried unsuccessfully all day Monday to call.  Later that night, I was contacted, and explained the situation.  Again, I was told there was nothing they could do, it was not their fault and that now I was qualified.


They are unwilling to work with me or refund my deposit after telling me I did not qualify.  All this qualifying suddenly happened after they saw me in another companies office.
