My husband was a Supervisor/Foreman for THE DASH GROUP, INC. employed for almost 7 years. This company employs on average less than 10 people. Until my husband was hurt on the job, the owner didn't even carry workman's compensation insurance. (That bill has still not been paid out by Shane.) Crooked you think, well, read further!

On August 8, 2007, DANIEL "SHANE" BEVILL, the owner fired my husband, Chris. The reason is unjustified. On this particular day, we were having a HORRID heat wave here. The heat index was over 120 degrees. My husband along with several other employees were working in the direct sunlight (no shade nearby AT ALL) on a newly asphalted parking lot doing paint striping of paking stalls, etc. One employee had to leave due to heat exhaustion. My husband radioed his boss on his Nextel phone to let him know of the dire circumstances and that it was just way too hot to be doing this kind of work and that the employees were getting sick. A little later, Shane, the boss, showed up in his air conditioned truck and told my husband that he "could get his sh*t and leave". There was another employee that witnessed this and QUIT on the spot because he found out what kind of a stand up guy his boss really was!

There were other jobs that could have been worked on as Shane seemed to always be shuffling jobs around (and 9 times out of 10 never completing a single one on time). It wasn't the employees' fault, in turn however it still made my husband along with the other workers look bad from a business stance. Anyways, my husband didn't give way for arguement and decided it best to drive his company truck to the "yard" (which is where all the trucks are kept and is no more than a grassy patch behind a shopping center without a Workshop or otherwise.) Chris got all of his personal belongings out of the truck, such as planner, coffee mug, his briefcase, and extra clothing and left in the truck his company cell phone and all keys. Several employees witnessed him doing this to account that he did not take anything else and that the items were left safely.

THE VERY NEXT DAY, my husband being the upstanding father and provider that he is, went out at 6am in the one vehicle we had to find another job. He found one and began that day. Later on that day, I went to get the mail out the mailbox and low and behold there is a letter from our insurance company, United Healthcare, stating that QUOTE "as of 8/1/07 your policy is cancelled due to your employers non-payment of past due premiums". I thought, 'you gotta be kidding me'!! So, I come back inside and am FUMING mad. I called the insurance company to find out more info. I found out that this was not just on my husband but rather all employees of The Dash Group. Way to go Shane! Ughhh! The rep told me that it looked like he hadn't paid the last TWO premiums for the insurance to remain in effect. Ok, so what does this mean? Well, any services done after 8/1/07 would NOT be covered. Great... because I had just gone to my OB/GYN the 2nd as well as a visit to the ER on Sunday the 5th because I had been getting very dizzy and sick with headaches. They did an CATSCAN, and you know those things aren't cheap! (It was found out I had Vertigo due to a SEVERE inner ear infection.)

Bottom line.... Shane took out over $335 per month ($167.86 each pay period) for "our part" of the premiums (he paid $30 toward Chris' part) to have this "GREAT" company health insurance. (This was just for me & hubby by the way, our children ages 8 & 2 have other health insurance plans.) So, if he had been with-holding this money as a pre-tax deduction from payroll, then WHY COULDN'T HE SEND IN THE DERN MONEY AND KEEP THE INSURANCE CURRENT????? It doesn't make sense to me! Oh, and add insult to injury.... the last paycheck Chris got (which Shane didn't get to us for another 2 weeks past payday) had an ADDITIONAL amount deducted for INSURANCE! Excuse me, but WHAT INSURANCE?!

On top of all this, Shane calls our home, during the day, about 1 week after all of this KNOWING Chris wouldn't be at home. He threatened ME and stated that he was "going to bash my husband's face in" and "don't think that this is over!" "keep in mind that I do know where you live"! I called the police to file charges and a report because I know for a FACT (it is documented several different times, most are public record) that he is a HIGHLY abusive/aggressive person. Another couple we know were threatened due to the fact that they wouldn't babysit for Shane & his girlfriend. Shane threatened them to the point that they filed a report with the law as well. He is not to be taken lightly on threats.

I just don't know what other avenues to try with going further with this. I have contacted the Georgia Department of Labor, The Georgia Insurance Commisioner's Office, Employee Services, and a lawyer who all seem not to be able to help. We want that premium money back that was deducted, because we now have medical bills that are needing to be paid because they were not covered. We also want some sort of criminal charges filed due to him "embezzling" this money and not returning it to us. It is rightfully our money. It would total $839.30. I get this by adding the two months where we had no coverage, but premiums were taken out, as well as the last payroll check being deducted this amount as well. 167.86 X 4 (2 payperiods per month) + the final 167.86= 839.30!

As of today's date, September 22, 2008 - There has not been any attempt made on Mr. Bevill's behalf to resolve this matter. We are going on 13 months later, which to me, seems a bit shady.
