My fiance and her two friends visited the rush fitness in Dalton, GA. The complex was relatively new and we had been talking about getting a membership somewhere. Well I was at work and received a call from her about joining. She said that They were offering very good deals and that we could add or remove any from the account if they didn't like it at no cost or hassle.

My fiance comes home with the paperwork and stated that I didn't need to sign anything, that the girl there whose name was Candace didn't care if she forged my signature. That struck me as odd, but I thought "Oh well, I'm sure there won't be any problems." A couple of days later we went to add my fiances mother to our membership and we find out that we cannot add her without creating a whole new membership. So after argueing and talking with the people at the gym, they wrote up a new contract and I signed it to get her mother added to the membership.

Now fast-forward 6 months and we have 2 of the 5 people not willing or wanting to pay their part of the contract. I ask while at the gym if I can have them removed because they are not wanting to pay their part and am told no, that its impossible unless I have everyone together, I am moving over 50 miles away, or have a medical disability. This is the exact opposite of what I was told in the beginning. So i call corporate offices to discuss what my options are. Like an idiot I am still willing to have a membership if they could change it to just my fiance and I or if they will just cancel all my memberships. Once again I am told that it doesn't matter what I was told at the gym, that they do not honor verbal contracts or agreements, and that only the contract that i signed is what is valid.

So now I am still paying for 2 people to go the the gym that do not attend and will not pay their part. There is nothing this company is willing to do to rectify their poor business practices used by their club staff and they also explain the only way to contact upper management is to email them? Needless to say, do not do business with the rush unless your going to have everything said written in a contract.

Candance did the same thing to us. We were never informed that they had a month to month contract. My husband was out of work, so I called to see what we could do. She told me that we should've signed the month to month contract instead of the two year contract. My response was what month to month contract? we are now stuck in the same situation as you are.....the Rush IMHO practices some shady business dealings.

1. No, im quite positive she did listen. I've been told by many people that candace has caused many problems with members by giving wrong information. Candace even tried to explain the same thing to me over the phone. She stated that we could switch members out, not exit out of a contractual agreement. Like for instance someone decided they didn't want to attend we change it to another person. You must have misread ssomething above.

2. I do believe telling someone false information to try to pursuade them to join a facility or sign a contract would be a poor business practice. Regardless of what my judgement may seem to you, I do not believe this negates the actions taken by your club AND company to gain new members.

3. I appreciate your reply and can see how it could be viewed from a company stand point, but the fact remains that your employee allowed someone to forge another persons signature after lying about the terms or the agreement.

Lesson Learned?

First: Your girlfriend obviously didnt listen to the membership counselor, or you misunderstood her. If you think about what you stated "we could add or remove any from the account if they didn't like it at no cost or hassle" you will see how ridiculous it sounds. Why would there be a contract if you could enter and exit it at any time?

Second: Your friends being unreliable has to reflection on the company. You should have not entered into a contract with people that arent going to pay their part. Thats like getting an apartment with a friend that you know wont pay his/herpart of the rent.

Three: "Poor business practice" is not a good way to define your lack of judgement skill.
