my landloard claims I smoked in the suite and it states in my lease its a non smoking suite. I dont even smoke!!! Its a basement suite I was at for 2 years. It is a safety nightmare and the heat is worse then most basement suites Ive experienced. only one window opens in the suite and the rest are screwed shut making it a safety hazard... the back deck is also a major safety issue as the support beams hare all rotten and ready to fall. I didnt damage anything in the suite and never smoked in it, however every tenant upstairs has smoke both cigs and marijauana. The basement suite used to be a smoking suite so there was burn marks on the hardwood and smoke damage to the walls when I moved in.

I had been staying ar my girlfriends for the better portion of 3 months when we decided to move in together so I told him I would be moving stuff over little by little and he may be able to rent it out early and to get back to me if he is interested in working out something reasonable like half rent for that month.. He emails me two weeks later to tell me that he has a crew booked to come in on March 16 to rennovate for the next tennant (already rented for April 1st) and if any of my posessions were still on site they would be removed from the suite and the cost for doing so would be deducted from my damage deposit.. I emailed him back saying I had paid for the whole month and that he cannot do that as its illegal entry. He emailed me back saying that I broke the lease by smoking and if I wanted to be resonable and overlook some things that he would see what he could do to give my damage deposit back. I told him I would like to but when im being blackmailed for something I did not do that I do not feel I trust him enough at this point to simply take his word for it. we would deal with the move out at the end of the month then.

I arrived at the suite March 30 (with a friend/witness) to take the rest of my personal items away but found there were already workmen in the suite and they were almost done the rennovations already.. the remaining items were piled up in the middle of the room and my 2500 dollar mattress was in the dirty furnace room hallway and was covered in varnish/laqure from redoing the hardwood floors.

He now wants to do the walkout report and Im not sure how that can be legally done when he has already rennovated the unit.

I have taken pictures.. have witnesses ready and all documented communications saved.
