Tom and Josie Pierce, dba Remax Realty of Cape Coral, allowed a Realtor to be working out of their office with an extensive past of violence against women. They did no background check OR chose to ignore it. Even after I reported what he had done to me. Besides his 'losing' $5,000 of my money...
On April 5th, 2005 David Kenneth Hernley (originally from the Seattle, Wash. area) was the listing realtor on my condo in Naples, FL. Knowing I am severely hearing and sight impaired without my glasses and hearing aids when I am sleeping, he accessed my home with the Realtor lock box, deliberately broke my telephone and stole things from my home as I slept. THEN violently woke me and physically hurt me in several ways. Attempted rape, more injuries fighting him off, threatened me as if a jilted boyfriend, whatever.
After posting him on sights, and later with a Deputy Sheriff volunteering a manila folder of his police data, I found out I was lucky to have gotten away from him and to a neighbor's home.
I hold the Pierces responsible for his actions, his even being in their office. They can sue the state of Florida if that is appropriate in this case, but their reputation and their ATTITUDE toward my phone calls to them concerning this were dismissed very smugly.

We dismissed Mr. Hernley from the office because of these allegations. He has not been associated with our office for over 5 years. Unethical and imoral behavor is not tolerated in our organization. It is not customary to do back ground checks on Licensed personel as the State has checked for felony charges, finger prints and does backgroud checks.
