In April of 2006, I went to Concord Toyota to possibly trade in my 2005 Toyota 4 Runner, which I purchased from the same dealership in April of 2005. I explained that I was only interested in 2 features in a new vehicle, a sunroof and a 6 CD stereo. I was shown only 1 model, which the salesperson said had both. I could obviously see the sunroof, and I saw the CD changer, so of course I believed the vehicle had the features I was interested in. In addition, the salesperson even showed me the sticker on the window, which stated the vehicle comes standard with the 6 CD stereo.

I was also promised a hood deflector for the new vehicle, as my 2005 model had one. So, based on the information from the salesperson, I decided to make the purchase. I signed the contract in good faith, knowing the 2006 4 Runner had both of the options I wanted, including the 6 CD stereo. The next day, I find out they do not have the hood deflector, and will have to order one. After 4 weeks of waiting, I called in to check on the status, as know one had given me any kind of status. Also, I was having problems with the 6 CD stereo, I could only put 4 CD's in, and not 6! So when I called, I stated my problem, and was told by Ed (Customer Relations Manager), when I come down for the hood deflector, they will look at the stereo. He went on to say, the vehicle should have a 6 CD stereo, and if it didn't, he would have it switched out.

Then 2 weeks later, on May 15, 2006 I drove to the dealership to check on the hood deflector and stereo. I was told, oh sorry, still several more weeks until the deflector could arrive. In addition, they looked at the vehicle, and said the stereo was only a 4 CD stereo, and not a 6 CD stereo that I had been told prior to making the purchase. Another Customer Service Manager (Terri Splendorio) looked up my new vehicles VIN#, to check on the features it was made with, and from Toyota's own factory directly, she said it was made with a 6 CD stereo! So now, you can see where I am going with this. I thought I was buying my dream car, with a 6 CD stereo, and I was told by my salesperson that's what I was buying. And again I signed the purchase agreement with the fact this vehicle has that feature.

Now today Darren M.(General Sales Manager), called me and tried to persuade me that my new vehicle was sold correctly. Even though the sticker on the window stated it came standard with the 6 CD stereo, he said since it came with a navigation system, it doesn't come with the 6 CD stereo. I said listed under standard features it also says it comes with 4 tires, and that's true, then Darren said some features are true and some are not even if they are listed as standard.

I then said that's false advertising, and that I was misinformed by his sales staff who sold me the vehicle. Darren said he was aware of what I was told (that the vehicle did have a 6 CD stereo), but since I signed the contract I was stuck with the vehicle. I said that is unacceptable, and I just wanted to return the vehicle and walk away from it 100% free and clear, since I was sold a vehicle that was represented as something it's not. Furthermore, I said that makes the contract I signed breakable, since they fabricated a story in which I was duped into believing and trusting I was being informed correctly! I only made the decision to purchase the vehicle based on the information I was told. Darren also tried to side step that point, and said brochures for the vehicle state what features are standard, and which ones are not.

I explained to Darren, I was never given a brochure to read, I was only making a purchase based on what I was told by his sales person. And in addition to listing the 6 CD stereo as a standard feature on the window sticker, the website toyota.com also lists it as a standard feature. After fumbling with his words Darren said it doesn't matter what that says, I signed the contract so I am stuck. Then Darren actually accused me of not being able to afford the vehicle, and said no one would complain over a stereo having 2 less CD's then it's supposed to! He obviously has no idea of what customer service is, or does not care if his employees lie to get a sale. So I am writing to you, because I feel I was lied to, have been told several different conflicting things by this dealership, and purchased a vehicle that was misrepresented to me for something that it's not. I feel this voids my contract, and I should be able to give them back this vehicle since it is there error and not mine. I do not want to keep this vehicle now, and after all this, I will never do business with there dealership again. Please help.

Thank you,
Jim
