my husband drove for western express for a year and a half, out of tennesee, but they were loosing all their kansas accts. so Joe thought he was going to go local with knight transportation, but after he left western, the thing with knight didn't go through, so joe went for oriantation with another company in texas, but after oriantation, they decided because he couldn't life 150 pounds they sent him home, so spirit express promised, a sign on bonus and all sorts of other crap. Joe went to work for them, he did one run, and the truck broke down, sohe took it back to denver for repair, something that should of taken 2 days took 7, and they didn't let him sleepin the truck while it was in the shop,so theyput him in a motel, knowing we life 550 miles away in osage city kansas, treating him like a local driver, having him do local work as his truck was in being serviced, after denying they promised a sign on bonus, and promising insurance after 30 days, we thought ok we can deal with this but on payday, he didn't get paid, and they acted like they were doing me a favor giving me a $200.00 T check, claiming Joe didn't fill out the proper paper work to get paid.. as if that wasn't enough, 30 days came and went and NO pay stub what so ever. then they told him he had to waite 90 days for insurance. he had back surgery in 04 and so he has a weight restriction on him and they knew it, they had all his medical records. so they put him under a load, with 11 stops in chicago, self unloading 80 pound house doors byhimself, knowing it would of puthim in a wheel chair, for 3 days he begged for them to take the load off of him, he even tried to get other drivers to take it off of him when it was useless, he gave them back the truck. and had his sister come get him.

he called western express and they said they would put him back to work, they put him on the bus back to tennessee, he did oriantation, come pay day no final check from spirit so I called them, they said that scince he quit on them, they quit on him and held right not to calculate his last pay check, I called wage and labor in denver they told me it was a federal issue scince it involves over the road drivers, and the federal wage and labor told me it involves state and is not their problem, then I got his pay stub, they charged him $500.00 for refusing the load, they charged him $75.00 for detailing the truck and they charged him $40.00 for missing lug nuts that were never there. and claim he owes them $68.00 still for hauling their freight, when Joe got done with oriantation at western express, they put him on the bus home and I have to go get him in the morning, they wouldn't tell him why, orgive legit reason, but I believe spirit express has gotten him black balled from trucking.. and everyone tells me it's not there problem, another thing with this company is they promise and contract to pay .34 cents per mile, but they really only pay .23 cents per mile, and fix their pay stubs. to cover up the fact they are evading the irs on taxes, what it boils down to is they have been in business for 9 years with 150 trucks, just in the 6 weeks joe drove for them they evaded over 2 grand in taxes now if ya take that and figure in for a year and the 150 trucks they have so far evaded taxes of over 40 million dollors, so they can totaly treat drivers like crap.

these companies are what gives the trucking company in general in the US bad reps for being employers who want everything for nothing, they get a way with it, because nobody wants to do their job at making sure in America everything gets done the old fashioned american way, an honest days work for an honest days pay, I am disabled, not brain dead, because I trusted he would at least get him last pay check I dared write checks to pay my bills, so now I get to pay bank charges, I pay for there cheating ways, and they should pay for what they have done, 3 weeks ago they accused him of causing 2 other drivers to leave them but the next week, there they were still driving for spirit and they even docked him pay for it. so I still got to pay. as I said, I am disabled not brain dead. can't somebody do something to make them remove their lies and black balled my husband???

I used to work for these guys, I sat alot. never made any money with them, just to think i stayed ther 8 mths but as to not getting your last pay thats just wrong, they did the same thing to me for out of rout millies, after Bob there said it was ok then he denied eveything i called and asked were my last pay was and that is what he said. I heard alto of things  but it would not be nice to say on here. the only time they were conserd was when i was hit by a strom in the summer. but Bob only cares about Bob.the saft. guy cares about the drives Bob don't

That may or may not be the case, but given the size of your company, why would someone not take a little time and assist a new driver, in order to make sure he is aware of the policies and procedures, so that there are not problems and accusations like this?

Robert Stated - "Pay stubs are deposited in the driver's folder at the office unless the driver requests they be mailed to thier home address. The claimant never made any such request."

I find this to be extremely unusual and suspect. This is the 2000's. Haven't you ever heard of direct deposit? Why would the default system be to hold the checks? I would think that mailing them in the absense of making a selection would make far more sense.

Robert Stated - "The 11-stop load to Chicago did not, as the driver claimed, require him to unload the doors. It was explained to him at the time of dispatch that he was not to unload the doors: the consignee would use a forklift to do so. With that knowledge, he agreed to the dispatch."

I find this to be the least credible of your claims. I've delivered windows and doors many times. 90% of all receiving locations that receive deliveries of home supplies of this nature do not have docks, much less forklifts.

The more likely scenario is that the load was indeed forced upon this driver despite known and disclosed physical limitations.

Robert Stated - "On Monday, 11/20, the claimant's truck and trailer were at the yard. He had abandoned the equipment and quit without notice. At the time of hiring, he signed documentation agreeing that if he quit without notice under dispatch, he would be charged $500.00 for the service failure."

I have a die hard rule. Any company that charges drivers for voluntarily terminating their employment does so for one reason, and one reason only. They have trouble keeping drivers. They are constantly dealing with the issue.

It's unfortunate that trucking companies have re-defined the word "abandonment."

It used to be defined as quitting and leaving equipment anyplace other than a company owned or leased property, and at a location where the company had to go to some expense to retrieve their equipment. That is no longer the case, and shame on you and all the others who trash people's records and reputation when they do not appreciate the sub-standard job conditions that you attempt to force on them.

Anyone who would dare shove piece of paper under my nose in an attempt to force me to agree to a $500 "fine" in advance for quitting without notice and while under dispatch, would get only one thing from me. I would stand up and politely leave. I would know immediately that this is a company that has severe issues and trouble keeping people. It's much the same thing as a company that plasters "No Firearms" signs all over the place, or that shields office staff behind plate glass windows with little holes to talk through. It tells me much more about the company than it does about their drivers.

Robert Stated - "Spirit Express Trucking, Inc. takes pride in its service record, safety record, and its drivers. Many of our drivers have been with us for over 5 years. The majority have been working with us for over 2 years."

It may well be that you do have drivers on staff for as long as you claim. It doesn't mean that your company does not have problems. In fact, you might want to check into your safety statistics just a little. I did.

Your company is running nearly double the national average of drivers being placed out-of-service for their logbooks. Your company has been audited and it has been ruled that your safety management needs some attention. Thus, your ISS-D score currently stands at 96, which is horrible.

You might consider hiring a new safety director, and seeing to it that your dispatchers are aware of their responsibility to dispatch loads that can be delivered within the hours of service R&R's.

I don't know about anyone else, but your company would never meet my standards.

I'm picky as the dickens who I work for.

Contradiction of several points made by Bob Junker

I am looking for a honest reliable company to work for. Thank you Rip Off for having this site so that people like me can read what is written and decide what the truth is by each person's statement. As a driver for over 15 years here is what I think is the truth.


If the man was paid for working he should of been sent record of that at the end of the year for tax purposes.

As far as not submitting paper work. I find that hard to believe as a driver ALWAYS needs their pay. They would never sacrifice their pay to a company by not submitting paperwork. One way of finding out if the paper work was submitted is by the driver first copying all paperwork before turning it in, then going back with the BOL # to find out if the company had been paid for the delivery.

I have never heard of pay stubs not being mailed to a drivers home. The wife of this driver seems to be pretty much on top of her husbands wages. Why would any company not send the stubs home where most everyone keeps their pay records. For a company to keep a drivers pay stubs in a file in someone's office just does not seem likely that any driver would go for that.

As far as unloading. I believe the driver on this one. We have been told take a load and they will take it off when you get there. When a driver gets to the consignee they tell the driver to unload it. The thing about this one is the fact I would have called the company getting a com check number and hired a lumper.

How does a driver abandon a truck when it is in the yard of the company? And since the truck was in their own yard how could the driver be under a load? The truck was not abandoned because it was in the company's yard. Didn't say how much of a notice the driver was suppose to give. Ten days, 30 days, 2 minutes. There was no mention of any time period. The company firing how much of a notice would they have given to the driver?

I am not sure about the IRS thing. I do know from our experience that companies do try to get away with things. Including trying to make reimbursements as income for the driver. Therefore, the company files it as wages paid out to the IRS. I don't know if this company does this or not, but it would not surprise me if there is something fishy about the payouts to the drivers. It would be interesting to go back and look at all the records by the drivers.

I don't know that the driver or company is correct. I just believe the driver because of the many experiences I have been through and witnessed by companies.

It's unfortunate that a company and drivers come into an agreement and its not followed. This continues to happen to drivers especially. Something needs to be done to stop companies no matter who they are. We need to start complaining to our Senators to start passing laws that companies cannot violate contracts of any kind.

I hope if this company did do these things that they change their ways. It's really sad that people work so hard for a company only to be disrespected by them, and then the companies don't stop there. They send DAC bad reports about drivers that are not even true.

I am so glad we have rip off because the bad companies will go out of business and the very drivers that had worked so hard for them and screwed by them will be responsible for their failure and loss of business.

There are multiple inaccuracies and accusations in this statement that are completely false. I will address a few of the more aggregious comments. I am confident that by doing so, the reader will have a clearer picture of the situation and be able to make an intelligent decision on whom to believe.

1. In September, 2006, at the time the claimant was hired, Spirit Express was not paying a sign-on bonus as claimed. The program began October 15th.

2. The claimants truck required repairs and was in the shop between 9/29 and 10/3. During this time, the claimant was housed in a motel (at company expense) and paid $14.00/hour to perform local deliveries.

3. Our health insurance is not available to new employees until 90 days. This policy is beyond our control.

4. The claimant did not submit necessary paperwork to compute his pay. He received his pay upon submittal of his paperwork.

5. Pay stubs are deposited in the driver's folder at the office unless the driver requests they be mailed to thier home address. The claimant never made any such request.

6. The 11-stop load to Chicago did not, as the driver claimed, require him to unload the doors. It was explained to him at the time of dispatch that he was not to unload the doors: the consignee would use a forklift to do so. With that knowledge, he agreed to the dispatch.

7. On Monday, 11/20, the claimant's truck and trailer were at the yard. He had abandoned the equipment and quit without notice. At the time of hiring, he signed documentation agreeing that if he quit without notice under dispatch, he would be charged $500.00 for the service failure.

8. The abandoned truck had not been cleaned and had to be detailed due to it's poor condition. The cost of detailing was $75.00, also agreed to by the claimant at the time of his hiring.

9. The claimant says the lug nuts were missing. If that were true, then he failed to report that fact to the company. By driving with missing lug nuts, he put himself and the public at risk should a wheel come off of his vehicle and cause an accident. This action is by no means endoresed at any time by Spirit Express Trucking, Inc.

10. The claimant was paid $.34/mile as agreed.

Assertions that Spirit Express "fix(es) thier pay stubs to cover up the fact they are evading the IRS on taxes" is absurd. Had this occured as claimed, the IRS would have caught on long ago. On the contrary, Spirit Express Trucking, Inc. maintains and pays its tax liability as required to all government agencies.

Spirit Express Trucking, Inc. takes pride in its service record, safety record, and its drivers. Many of our drivers have been with us for over 5 years. The majority have been working with us for over 2 years. We pay wages very competitive with current market rates and treat employees fairly and with respect at all times. It is unfortunate that the claimant has made such onerous and unfounded accusations. I invite the reader to investigate for themselves the claims made and make your decision based on fact, not accusations.
