I called the number on the letter and asked what it was about and the gentlemen on the phone requested my social security number. I refused to give it to him and he stated he had to have my social security number to validate the account.

I told him that I have never had an account with ATT Wireless and didn't owe this debt and said this was a fraud. He continued to state that he needed my social security number to validate the account after I had already given him the reference number on the letter, my name, and my address.

I also found out this company is doing business under three diffrent names one is Collins Financial Services, and CTI,Palisade Collections.I live in North Carolina and any company that does business has to have a permit to do Collections.

I have filed a complaint with NC Department of Insurance. These people need to be stopped destorying peoples live and comply with the Law.Also these company

POSTED: Thursday, December 01, 2005

I used to work for CollecTX. Now that, that is out of the way.

1st CollecTx, CTI, Asta Funding, Collins Financial Services and Palisades are not the same company.

Do some research and you will find that out...
Asta funding does in fact own Palisades Collection.

CollecTx and CTI are one in the same.

Collins is a seperate entinty in itsself.

CTI does contingency work for palisades at times.

AT&T wireless submitted all of the information to the company that purchased the charged off debt (Charge off does not negate the debt it is a TAX TERM).

There are true cases of fraud out there (I have been the victim of fraud in the past) and there are mistakes made by a skip tracing company... Those are the companies that are hired to locate people that dont want to be found or are not at the address of service in this case.

When they asked for your SSN they were doing that for security purposes only. According to FDCPA (Fair Debt Collections Practice Act) they can not disclose to a 3rd party. --- That is why they asked for that.

The information that was provided was from AT&T, in most cases (I worked dispute and fraud) the person in question had worked for a company that had a cell phone assigned to them, the employer sent them to AT&T to pick up the phone and unbeknownst to the employee when they signed for it they signed the contract.

To dispute a debt do this instead of jumping the gun:

Go to FTCdotGOV and fill out a fraud/dispute packet, the collection agency can send you one or direct you to where you can get one.

Call the collection agency, and if you live in a 2 party state record the conversation, explain not yours and dispute it,

Fill out a Consumer Dispute Verification Form and submit it, once they received the CDV they have 30 days to respond to validate the debt,

Send the collection agency a written dispute, send it certified (
File a fraud report with your local Police department will say it is too old or they cant do anything but file the report get a report number and inform the Collection Agency.

If the trade line (
IN re to the Better Business reports unless a person agrees with a companies remedy then it will be unsatisfactory,

IN RE Female in NJ:

All debts past (with in the statute of limiations can be collected) if you live in a garnishable and leinable state the agency can place your account with an atty for suit, which by the way more are approved then they are denied.

you stated something about an auto deficiency loan. that was the balance that the bank did not recover from selling your car.

You CAN NOT GO TO JAIL FOR A BAD DEBT! They can garnish your wages and put leins on a home (if state law allows) and and in some cases place leins against a car. But you WILL NOT GO TO JAIL.

Unfortunatley bad things happen to good people but again unfortunatley the debts were incurred and the debts are still owed.

Yes there are some very very unscrupulous collections agencies out there and they do not stay in business for a very long time, Feds to not let them.

Follow the advice above to dispute an account, do not go to one of these I will fix your credit for x$ and they do for about 4 months but everything they did you can do for a lot cheaper.

I know people get upset but please think before you leap.

BTW, CTI/TXcollect is an agency that will do its best to help you if you are in the right and will also do its best to help you when they are wrong. Also know that when an acount is sold to another agency that there an indemity clause and that there are also bills of sale and affidavits that the debt is actually legit.

If you contact the Orginal Creditor they are bound by contract to refer you to the other agency, If you bring some sort of action or was previously settled the Orginal Creditor if it is within the Reps and Warrants period can recall (pull the account) back to them. If you do contact the orginal creditor and they tell you that there is a zero balance they are not lieng to you. On their books there is a zero balance due the the Charge off AKA Profit and Loss Write Off, again this does not NEGATE THE DEBT it is still owed. Each state has a statute of limiations on the amount of time that legal action can be taken, know this A lot of agencies will take it when that deadline is becoming short.

Things to know about a debt collector,

They can not call you at work IF YOU TELL THEM YOU CANT RECEIVE THE CALLS.

They can not call you before 8am or after 9pm on a given day (most closed on Sunday).

They can not knowningly harrass you.

They can not can not threaten you.

They can not pretend to be something other than what they are a debt collector.

They can not disclose to a 3rd party the nature of the call (spouse is not a 3rd party howeverin 5 states there is a non spousal disclosure law)

They CAN NOT threaten legal action UNLESS THEY INTEND TO TAKE IT.

-----

They DO NOT HAVE TO settle the account out for less then the full balance if they do not want to.

I hope this helps someway somehow

Gl to you ,

IN Regards to ASTA......

AUTHOR: Gloria - (U.S.A.)

POSTED: Wednesday, January 26, 2005

Hey Everyone, I think were on the same wavelength today! Guess What ASTA funding is doing to me? He's the drama....OK, I have debt...single mom struggling, went from 50,000 a year to 16.....getting out of it, not...My last attemt at a credit card was in october of 2002.....I get these letter sent to my Mother's address from a collection agency called Palisades, from Englwood, NJ...Ofcourse, when the car was repoed in june of 04, my last thought was them....plus 15 other creditors....

I did move at least 6 times with my ten year old daughter, it's kinda hard to survive in NJ without a car...worked where I could, did what I had to do.....I went on unemployment in Dec. of 04....meantime, I still get the letters from Pressler & Pressler, representing Palisades. I re-opened an old checking account with my unemployment...got proof...Jan 4th, 05, guess what, my account is levied...by whom? Pressler&Pressler fronting for
Palisades.

I faxed them the proof, what did I get but a warrant for my arrest.....the 17th....they were notified the 11th...Judge also signed it to, that if I do not respond by the 28th, they will go ahead with my arrest, no further warning..Guess what?

I call the Debt, Providian...they sold it to ASTA...who is ASTA but Palisades, one in the same address....they by the debt for about 12 cents on a dollar, turn around, and charge the consumer fully for the debt that was owed to the cc company. I think it's time we all found a good lawyer, I'll let you know if I am in Jail! Something has got to be done, this is insanity......
