Since April I have been having issues with UFS posting payments to my creditors. In August, some progress was made and the past due payments were all posted at once. UFS also had to resend new proposals to my creditors since I had been dropped from the programs (which I later found that many did not get a new proposal). I thought this would be the end of that trouble. Boy was I wrong.

My creditors have not gotten payments since then, but UFS religiously takes out $407 every 17th of the month. I have not fallen behind on paying them and I have advised them each time my payments are late. This go around, I have worked with Pamela and Clarence. Both of which were taking care of my having my accounts correctly credited. Clarence advised me on Tuesday, November 2 that the payments were being reissued out by the accounting department that Wednesday, November 3rd and that it would take 5-10 business days for the payments to be reflected in my account.

It is now November 19, 2010, 13 days from the day my payments were reissued. A whole other collection of $407 later and there are still no payments. I have been trying to get in touch with anyone with the office, but conveniently their phones have not been working the past week.

I have also emailed Jaime Lyons as others who have complained have done and were sent notice that my email was deleted. I resent the notice specifically asking for my email to not be deleted this time around. I received the read receipt, but no reply. I emailed her again today; I got a read receipt and no reply. I have not gotten a phone call or email. I have also faxed my situation to UFS and still, nothing.

I do not know what to do anymore other then file a complaint with the attorney general and get a lawsuit going in a small claims court. If I was able to talk to someone I wouldnt be thinking so drastically but since I cannot get in touch with anyone over there since their phones keep giving an invalid entry response. I cant get anyone in new clients, customer service, operator, and even have tried going through the Spanish prompt, nothing.

I do not know of UFS is just trying to avoid their clients or what is going on with their phones but it is very disturbing. I have fallen behind 3 months on payments because of UFs, have accrued over $148 in late fees, and have been dropped from the program by ALL of my creditors. I need a full refund of the payments that have not gone through, of the late fees that I have been penalized with and my first month deposit, since UFS did not stick to their end of the contract.

If anyone can help, whether it is someone from UFS getting everything cleared, or if anyone knows of a lawyer to recommend or of a case already being filed on UFS please send me the info.

My experience with UFS mirrors all of yours:

This relationship has been a train wreck since day one. I monitor my accounts like a hawk and knew exactly when monies were being withdrawn and then sent to my creditors. My daily job has been to communicate with them to find out where my payments were/are. I have had to change the due date on my accounts 10 times! My history with them would fill up the entire page here. I have filed complaints with the Attorney General's Office as well as the Better Business Bureau. I have even forwarded a complete copy of my file/communication with them to First Lady Michelle Obama's office. They tried to get me to sign a release/confidentiality/settlement agreement this morning and I almost wet myself from laughing so hard. This company is a scam and needs to be stopped. Right now they have $702 of my money and I am not backing down. We need to begin a class action suit against them.

I believe if you cannot find a lawyer to do pro bono work it will cost a small fortune. You need to get out of this unfair relationship, and may have to shift accounts around to untangle yourself from this noxious company. I found a way to handle problems like this is to have two banking accounts, ideally one in a credit union since they will stand up for you in a situation where you are being defrauded, and a bank. In my case the credit union is federally bound and operated. If one account become a problem you can shut (or shift) the account, then shift all your funds to the other institution. Like I have been closing accounts and then paying them off before the problems escalate, and have taken in some cases a financial hit. Small claims can work, yet in my state by law corporations MUST have a lawyer present, which means the "David and Goliath" aspect of this court system is mostly washed away. And in our state a corrupt system of judges have been found to be paid off - it can be a dirty little problem that can take away your proverbial shirt. Class action suits could work, yet this must represent a systemic problem nationwide, yet I do not have any experience in this area. I know that a place that gouged me named QUICKEN LOANS had a class action suit settled for their workers recently, yet the potential customers who have fallen victim of their bait and switch and deposit scam have yet to be a a positive outcome.
