                                 Kenkote vrs Gore breakdown dated:

A    -Friday 5-3-13 am  Mrs Gore is stalling on a signed contract and I say in email “i need to get final contract signed before I purchase paint or start painting, any delays will effect finish time.”

B-1    Friday 5-3-13 am  Signed contract by Mr. and Mrs Gore to paint entire home for amount of $6411.00  and with a signed change order of $255.00 signed  Contract is very specific for semi-gloss sheen on cabinets .  

B-2   Friday 5-3-13 12:13 am  Quote from email attached to signed contract  : Since the laundry room cabinets were in the original bid, we substituted spraying inside the glass front cabinets with the semi-gloss swiss coffee that is already in the sprayer

C    Monday 5-6-13  Fri -Sat and Sun - Kenkote Painting painted most of the home filling Mrs. Gores requirement  for her Monday complete move in, including furniture.

D    Wednesday 5-8-2013  Kenkote completed 90% of contracted work, replacing all cabinetry,cleaning up all debris and removing tools. (Areas not finished are do to Mrs gore not selecting colors for one room, one finish coat on vanity in powder room, plus two walls in large livingroom..

E   On the 5-9-2013 Mrs Gore agrees via email to leave progress payment in drawer for 5-10 in amount of $2500, none left,NO RETURN CALLS

F   Friday 5-10-2013 at 12:43 am Gores sends email to Kenkote stating sheen applied to cabinets was not painted as discussed.  Claims Decorator has say of finish. Claims cabinets are “more representative of 90’s kitchen” By morning Kenkote receives call by contractor  saying Mrs Gore demands to have entire kitchen repainted to lower sheen.

G    Friday 5-10-2013 10 am I enter house to find no check, Mr Gore came and tried to leave without encountering me, when approached, I explained I left a sample of polyurethane on painted area so he could see it adhere, Mr Gore said he had no say in matter and was going to paint stores to verify if product could adhere as Mrs Gore instructed him. For three hours I sat there in the home with nothing to do but take pictures of work completed for records. NO RETURN CALL byeither Gore.

H    Friday 5-10-2013   12:31 Text to Victoria cell : I am at the point where I need to call off Melissa ..I have no way to pay for her (glazer) and you are holding up my money that I’ve earned in the first faze (sic) All this makes me want to quit altogether ….i want to finish and get you moved in but you are hindering progress.               NO REPLY

    I never heard back from you today, I would like to find a resolution to whatever issue you have. Monday I plan filing a mechanics lien on your property, in your profession you know this can be problematic. If you guys are frustrated with other people involved in this please don't take it out on me.I have a lot invested and need to be paid for what I have done. Thank you for understanding - Ken

Here is my proposal, we write a new contract, I will remove $1000 and you have someone you find to glaze and finish cabinets. You can do that In a week or months but get moved in. I will finish everything else like proposal states.I will need  $3000 for work already completed in other parts of house.   $6731 - minus $1000 =    $5731   minus $3000  = $2731 paid when your satisfied with everything on contract.   I know this is more than fair.                              NO REPLY

K    Saturday 5-11-2013  I reassure Mrs Gore through email that top coat of final  finish can be satin so there is nothing to worry about.. I also send Mrs Gore through email product information and articles written on subject -              NO REPLY

L    Sunday May-12-2013       After no communication I call and left a message that I am coming over to work this out(Gore’s considered a threat and stalking), Mr Gore calls back and said lets end working relationship  and work out difference needed.  After i showed up, We walked the home agreeing all the rooms were done to satisfaction until we reached kitchen.  Mrs Gore emphatically said this room wasn’t done to her specifications, I held up contract stating I followed what was on signed contract. She said she would have another painter come in and redo the cabinets and would only pay me the other work completed but zero for the kitchen.  I felt this was a take it or leave it proposition and felt it a an unfair tactic.Things just became unbearable and I left.

M Monday May13, 2013    Mrs Gore receives letter from decorator via email (later sent to me) stating : that after speaking to many painting pros the satin polyurethane will adhere perfectly and add another layer of protection ( to clear up any confusion)

N   Monday May13, 2013    10:41 am  Kenkote sends “last resolution effort” offering to settle the $6671 balance for $5009 -    

O   Monday, May13, 2013         2:33P pm      Gore’s counter with a $3250 resolution, offering $1220 for the kitchen and nothing for other projects almost finished.

P   Tuesday, May21 2013     I sent email warning that I’m going to file Mechanics lien on home and warning it will cost around $300 and they will be responsible for cost. NO REPLY

Q   June 6th, 2013        Kenkote Painting filed mechanics lien  in amount of $6771. for breached contract

R  Sept, 5th 2013     Kenkote Painting  filed lawsuit against Mr Mrs Gore for breached contract.

S   January, 8th 2014  Mrs Gore’s decorator sends picture of kitchen finished with my original paint 8 months later. Kitchen looks like something out of a magazine.

T   January, 16 2014   Mr and Mrs Gore file complaint against my license and contractor bond

Mrs Gore’s file against my bond was an egregiousfraudulent claim!

Mrs Gore sent in a bid sheet claiming inflated repairs were repaired by un-licensed painter Dolan’s Painting, using a bid sheet without signature, or date. Amount $1300

Mrs Gore sent in bank records totaling $1130 to Nick Dolan.

U   January, 16 2014    Suretec Bonding notifies Kenkote Painting is liable for all cost accrued with  Mrs Gore claim .

V   January 21st 2014   I call Mr Nick Dolan of Dolans Painting (858-752-9548), He verified painting everything I was not able to finish, plus extra stuff around the house. One specific claim against the bond paid to Nick Dolan is a removing paint off the hardwood floors for $400, Mr. Dolan denied this amount  and denied most repairs charged. Another Claim of $ 150 for powder room bath cabinet was proven false by Mrs Gores general contractor Tom Barrigan(619-954-6314) ( of TLB Construction, he found missing drawer in the kitchen cabinet and installed for free.

The Gores are demanding $ 4780 for painting yet completed they claim(8 months later), they are using an estimate from Mr. Ds Painting service, no signature,no contract  and Mr Dolan claims he did this work too.

It is my belief Mrs Gore purposely ended our working relationship thinking she can get her handyman in to finish for much less.

Any claims of damage by Gores were never expressed till  May 13th in Mrs Gore’s resolution letter. Never was there a claim of poor workmanship, I question the validity of most claims.

100,000  dollar Claim of business/livelihood damage is ridiculous, Mrs Gore can dish out internet reviews but can’t handle the truth exposed in mine. Never a mention of her business!

Gore’s Breached contract : not entitled to any part of the sum until he himself done the thing he agreed to do, unless full performance has been excused, prevented, or delayed by the other party. Lowy v. United Pacific Ins. Co. (1967) 67 Cal. 2d 87, 92

Gore’s used unlicensed contractor to finish all work Kenkote Painting was not allowed to finish.

Gore’s fabricated bid sheets for damages, and show no real proof of any damages.

Gores continue after 8 months to enjoy kitchen cabinets as Kenkote Painting  left them.

Mrs. Gore created a very hostile working environment.
