My husband and I were contacted by Viking for a bill owed to Capital 1. This bill predates my marriage to my husband by a few years. My husband found out it was from Capital 1 after he called to see who they were because we were tired of getting messages on our phone.

We tried to work out a payment with the first person we spoke with to no avail. We were then transfered to her supervisor, Frank Valdez. My husband gave alot of financial info to the original person we spoke to and Mr Valdez reviewed it.

After reviewing our income and bills Mr Valdez stated that we had 2500 dollars per month that was not being spent on paying bills. At this point my husband told Mr Valdez that we could only afford to pay him 75 dollars at this time. He refused to accept the payment.

After listening to this person speak to my husband on the phone for 15 minutes I asked my husband for the phone. I then spoke with Mr Valdez. He informed me that by his calculations we had an extra 2500 dollars and wanted us to pay up now. I told him that was not possible and that he could have 75 dollars, at which time he told me that he would not accept that payment.

I again told him that was all we could give and was told that he found that hard to believe. He asked me what our plans were for our extra money and I told him taht we had no extra money, at which point he told me that he thought that we could defer payments on our cars and other bills. I told him that was not possible and that he could have 75 dollars and where do i send it. He went on to say that he believed that we would go out and buy another new car.

At some time during this conversation I asked why they were getting my financial info and was told that they could because I was married to my husband and we lived in a community property state. (Is this in fact true?) When I stated that it really wasnt my bill he said that I had married into it. But then later said that if it wasnt my bill to put my husband back on.

After Mr Valdez hung up on me for not bowing down and paying him more I called back to ask for a supervisor.(I owuld like to pay this bill) Mr. Valdez refused to let me speak to a supervisor and then said he was the supervisor.

Is there anything we can do. This is a legitimate bill and I would like to pay it.

Before you pay ANYTHING to a debt collector, you need to find out the following: Is what you owe still in the statute of limitations? Does a collection agency need to be licensed in your state to collect and, if so, are they? Do you have anything in writing from this collection agency that proves they actually own the debt? Have you sent them a letter, certified mail, return receipt requested, demanding validation of the debt? Are they on your credit reports? I applaud you wanting to pay for a bill you owe, however, you should also get IN WRITING from Viking that if and when you pay this bill in full with the amount due clearly stated, that it will be a PAY FOR DELETE (in other words, it will be removed from or never put on your credit report).
