Recently visited Cabo San Lucas where I stayed at Villa del Palmar.  I went to a timeshare presentation at El Arco (villa group) and signed a contract for a timeshare.  Now I am finding out the repercussions of my bad decision.  There was misinformation and deceit from the very beginning by Villa del Arco and the Villa Group so BEWARE if you travel to Mexico and attend a timeshare presentation.  First off, I signed assuming I was signing in 2010 for the next year so I could vacation then.  They also told me the first year maintenance fees would be included in purchase price.  This is not the case.  They are now calling me and asking for maintenance fees from last November until now (approx $700 total) and also asking for my monthly payments.  I just put down over $4000 last month and they already are expecting more and I was under the assumption that I wouldn't be vacationing until next year!  The contract was very small print and my sales rep-Rita-was very confusing.  There were 3 other witnesses to this event and they were confused after the fact also.  There was loud music the whole time(only turned down at times people bought so there was silence when champagne bottle was popped), many different "higher up" sales people would come over and add some more non-sense and etc.  What a mess!  On top of this, before I signed, I asked if they run credit checks and etc?  The main salesman said that they don't and that it was "Mexican financing."  I asked what happends when someone doesn't pay, he said that they recoup the loss by keeping the down payment and then resell the unit.  That is not true.  I was informed that it was actually a U.S. based company and that I would be referred to collections and etc if I didn't pay.  I will be contacting the BBB, attorney general for California, the Mexican governing body for consumer complaints(PREFECO) and I may even fly down to Cabo again to actually talk to someone in sales from El Arco.  I have not been able to get a hold of anyone from Universal Vacation Group, Villa Group, and etc.  No one returns phone calls or emails.  If someone answers anywhere, they refer you to another person and they do not help either.

This company is one of the most fraudulent developers ins the timeshare industry. The only thing you can do is cancel your timeshare contract. I recommend you to visit  http://www.timesharescam.com/blog/198-beware-of-the-villa-group-timeshare/, there is good information about these fraudulent companies.

What is Rescinding a timeshare?

AUTHOR: SandraLaw - ()

POSTED: Wednesday, June 11, 2014

What is Rescinding a timeshare? Rescinding a timeshare is a legal way to cancel a timeshare contract, sometimes with the possibility to get your money back and usually within a certain number of days, this depending on the place where you purchased the timeshare. In Mexico, there is a 5 day cancellation period, and even though some timeshare salespeople might ask you to sign away your right to cancel during the sales presentation, you still have the legal right to rescind.

I have had dealings with UVC, the Villa Group Developer and ResortCom for the past 10 years and fully understand your frustrations.  I recently published a website addressing many issues and concerns (www.universalvacationclubmembers.com) and request you to read and respond.  The only way we as Club Members can gain strength is through communication and numbers.  Thank you.
