DISGRUNTLED EMPLOYEE SEEKING RETALIATION

The report filed by Mr. Leland **** does not paint the full story.

His job entailed caring for pets while owners were away from home. VIP Sitters' prides itself as a professional service and as such, our sitters are required to check in with us when they arrive and leave clients' homes. Mr. **** did not check in on several occations. When I reminded him that it is for the clients', his, and the company's benefit to do so, he dismissed my request.

Furthermore, one of our clients who used us for the very first time, had asked Mr. **** to call her when he first arrives at her home to put her mind at ease. She did not hear from him and called our office. When asked why he did not call this client, he yelled at me and told me that he's doing his job and 'not to worry about it'.

During his tenure with us he never boarded any pets; mainly because he is a smoker and the majority of our clients are non-smokers and specifically ask that the sitter not be a smoker. In his complaint he noted that the pets are not boarded where we say they are, this is simply not true!
Additionally, our chief concern is our boarders safety and comfort above all. Our home-style boarding is conducted at our home or our sitters' homes and the number of pets are limited to 1-5 dogs ration and sometimes 1-1 with private boarding.

Lastly, when Mr. ****'s contract was terminated, I attended his home to obtain our clients' keys and company supplies. Our interaction was professional and he was very helpful in working with me to do the hand over. I was very impressed with his organizational and scheduling skills; he was very patient in reviewing each client's pet with me and their status when he last saw them. I left the meeting feeling well informed and was sure that although our working relationship has come to an end, at the very least it was an amicable departure. I reminded Mr. **** to submit his pay on the usual day (Tuesday) for us to generate his pay by Friday. When we didn't get his pay I followed up with three telephone calls, each time having to leave a message, and reminded him that his pay was due and that if we do not receive it by Wednesday morning, that he would have to wait two weeks (until the next pay period) to receive his payment. Mr. **** did not return any of my calls.

On the evening of December 31 without any notice (more than a week past the payment submission due date), Mr. **** showed up at my home, and demanded to be paid immediately. I asked him to leave his paysheet with me and said I will make sure his pay is processed on the next pay period. He refused to leave my home, even after I had asked him to do so several times, and began to kick and punch my front door; upstaging the pets we were caring for at the time. I gave him one final notice to leave and urged him, again, to complete his paysheet in his vehicle and leave it with me, to which he declined to do. I eventually called the police and he fled my home.

In spite of all of this I still very much wanted to end on a high note and pay Mr. ****. It wasn't until after he proceeded to email our clients an alarming note that was bashful of our service, that I decided to not pay him. I cautioned him BEFORE he sent this note and told him that I had every intent to pay him but that he is not to have contact with our clients; especially in a way that would cause them unnecessary distress. When he failed to heath my warning, I sent him a cease and desist letter.

CLIENT LETTER 1

"These emails from Lee do not instill a great amount of confidence - particularly when I'm paying.
Can you please confirm that my bird was attended to on Dec 30 and Jan 1."


CLIENT LETTER 2

"Dear Kyle,

We continue to get e-mails from Lee (Leland), the person you arranged to watch our house. Three e-mails today, in fact.

In one of his e-mail he suggests that, during that time that he was employed by you, he used his position to take photographs of things belonging to the homeowners. I don't know if he only photographed people's pets, or other personal possessions, too.

You can imagine how seriously we take the possibility that someone whom we let into our home used the opportunity to take unauthorised photographs of our personal items.

Do you know anything about this?"

After his threats to 'expose' us (on Dec.31 & Jan.1) fell on deaf ears, Mr. **** tried a different approach (see his email below):

So when I die, just remember how you ripped me off, and treated me, as I have no trust for anyone anymore................

BOARDING SERVICES NOT BEING BOARDED WHERE YOU THINK

Should anyone decide to use this service be very careful if you are boarding your Loved Pets, as Kyle Freeman CAN NOT ACCOMODATE all the animals, but takes them on and then passes your Pets on to someone else, not his home where you think your Pets are going to be boarding.

ie: Kyle Freeman called me and begged me to take a doggie for him because, Max is a small doggie and Kyle had 13 very large dogs already, and felt that the bigger dogs would pick on the Max.

In the voicemail you left me today at 9:22 a.m. you indicated that if I don't call you within the next 15 minutes.the email will go out to those clients. Since we are operating on a holiday schedule starting at 12:00 p.m. and I just received your message, I take it, as you indicated in your message that you had by now, sent the email dated Saturday, December 31, 2005 8:41 PM to our clients.

In my previous email to you, I made it abundantly clear that if you chose to send this email that any monies that are potentially owned to you will be considered forfeited by you and considered to be collected as damages for any mischief that you attempt to affect in relations to our clients.

I truly regret that you chose to contact our clients in spite of the consequences (of not receiving potential monies owed to you).

This is the last communiqu I wish to have with you and ask that all future communications be done through the courts should you chose this avenue.

Your behaviour has caused me great emotional and physical distress and anxiety and I do not wish to have any further contact with you.

If you chose to contact me anywhere by any means (i.e. in person, through the telephone or email (electronically), or through post/delivery) other then the court system, I will contact the police and press charges against you for harassment.

I really did want to end this on a positive note, however you chose to continuously not cooperate with our process of paying and persistently threaten us, both last night to break down the door and vis a vis email to attempt to smear our company's reputation, has lead me to this.

Dear Lee,

Please allow me to respond to each of your points.

First of all I am a nice person and have been nice to you from the get go. The good work that you initially did for us was overshadowed by your reckless behaviour and lack of communication. I have never met a person like you who is such an extreme dichotomy. On the one hand, you are so well organized, seem to care for the pets greatly, and impressed clients during your meet and greets. All of a sudden, you become incommunicado, fail to respond to any of the voicemails I left you and not check in from any clients.

Your contract clearly indicates that in order for you to be paid for an assignment you have to check in and out of a client's home, and that failure to do so means that you do not get paid. Each and every assignment you completed for which you submit a pay sheet and for which we can verify a check in/out you will receive pay for, once you submit your pay sheet. The exception to this is the assignments I had to do on the 27th due to your lack of response and the fact that the story you told me on that day regarding which assignments you did and which you did not, was inconsistent, hence I had to do all the assignments on the 27th myself.

It may, on the surface, appear that you made lots of money for us but your sudden disregard for our clients' pets well-being and failure to commit to the timelines set out by the clients may has and may still result in clients' dissatisfaction; potential loss of revenue for us, not to mention the damage that you caused to the company's reputation. You started famously but ended on a very bad note, the reasons still bewilder me.

The notion that the hit and run' that took place when your car was parked on your street had anything to do with the work you did for us, is ludicrous and nonsensical.

One of the major challenges that lead me to terminate your service with us was your complete and utter disregard for my personal time. Dropping off, unannounced is simply rude behaviour, especially when you drop by on New Year's Eve and expect us to login to our accounting system, verify your time sheet, and produce a cheque, pronto. Just because you do not get what you want, when YOU want it, does not make me a bad guy. I really think that your perception is somewhat clouded, to say the least, and that you really need to think about how your action affects others. Had you submitted the pay sheet as you were trained on Tuesday, your pay cheque would have been produced by Friday and mailed to you.

What I find particularly irritating, is the fact that you did not return any of my calls, even though I was calling to discuss your pay, and that days after my calls you have the audacity to show up at my front door demanding pay NOW. You have to show more respect for people's time and realize that your priorities do not over-ride other people's lives.

Your behaviour tonight was abhorrent and illegal. I politely asked you to leave and explained that I was busy with clients. Rather than respect my wishes, you decided to act inappropriately by persistently ringing my doorbell, banging on the door, and kicking my door. It was only after your harassing behaviour and refusal to leave that I contacted the police.

The fact that you have no money for New Year's is completely your fault. Because had you called me I would have gladly obliged and would have made sure that you would received the monies that you had earned once I was able to verify the check ins/outs.

I did not f**k you over as you claimed; you did that all by yourself. Had you behaved professionally on December 26 and 27 we would not be having this dialogue.

I invite you to call me when you have settled down and are ready to talk sensibly. We can book a time to meet that is mutually convenient and agreeable for us both.
