We purchased two vehicles at two different times; my husband and I were on one loan, and my daughter and I were on the other. Both vehicles were financed through Wachovia. When both vehicles were purchased, Wachovia knew I was disabled, I had to disclose my source of income, which was SSI.

My daughter paid faithfully on her loan, usually paying early every month, and more than the minimum payment amount. About 18 months into her loan, my daughter lost her job. I attempted to keep up on her car payments and insurance, while still paying all my other bills. I did this for about six months, then started falling behind on my own payments.

When I first started making my daughter's payments, they were often a bit late, as I had limited income to work with. Wachovia was relentless. They called me often 30 or more times per day, to the point I felt I was being stalked. They knew I was critically ill, yet they called as early as 6:00 a.m., and as late as 11:00 p.m. They called me, my daughter, and even eventually called my husband (who was not a signer on the loan). The calls from Wachovia collectors started out nice enough, but soon turned into rude, crude language and disparaging remarks to and about me. I was told I was stupid and lazy because I was disabled, and that I should get a job and pay my bills. The collectors used terrible curse words to me during phone calls which were allegedly being recorded.

It finally got to the point that my health declined so much I had to put a stop to it. I filed a Complaint with the Comptroller of the Currency about Wachovia's collection "practices." They, of course, denied everything.

On June 15, 2009, a tow truck came onto our private property (which is clearly marked with signs which say "Private Property, No Trespassing," and STOLE my daughter's car. We were not notified via letter, either regular mail or certified mail that the car was being repossessed. The tow truck driver left in such a hurry that we didn't even know he had taken the car. When we attempted to find out where my daughter's personal belongings were (including a Breast Cancer license plate), we were told we could not get them. Finally, we were told we could come to the tow lot, but there was a $35.00 charge to obtain our own personal property. I told the tow yard we would be bringing a police officer for posterity, and they told us we could not and hung up on me!

About 3 days after the car was towed, we received a letter via regular mail indicating Wachovia would be repossessing it. Then, on June 29th, I was home and the same tow truck showed up to take my vehicle (for which was really only about 45 days late on the payment). Again, I received no prior notification of the repossession, and the driver came right into our carport. I did not let him have the keys, but did let him take the vehicle. I was too sick to fight Wachovia any longer.

To put the icing on the cake, my daughter and I received a call while we were out one day from our insurance carrier that Wachovia was attempting to file a claim against OUR insurance on the Ford Focus for damages which occurred AFTER they repossessed the car!! I told the insurance company to absolutely NOT pay the claim! I received a call today (July 14), from the insurance company that Wachovia is attempting to claim there is over $1,200.00 worth of damage to the car. There was one very small scratch on the car when it was purchased over two years ago - and virtually nothing has happened to it since that time.

My health has become so much worse over these entire incidents, and I am sick over losing both vehicles. My daughter's car was her first car, and I put money down on my car which my mother left me when she passed away. Not only does Wachovia not care about its customers, they don't hesitate to slander their names, defame them, curse and swear at them, steal their property and commit insurance fraud.

I myself filed a "Rip-Off" report against Wachovia Dealer Services, who has repossessed two vehicles from me. I was reading similar reports on this Website, and saw that many of you complained you did not know who to contact at Wachovia, since they obviously will not provide you any assistance when you are complaining about them. I was a paralegal for many years, so, even though I am angry, as are all of you, I want to make sure my retaliation against Wachovia is done correctly. I am now posting the name, address, phone and fax numbers for a "Liason" to the Office of the President of Wachovia Dealer Services. I would suggest you all bombard them, as they have done to many of us, with constant phone calls, advising them that they obviously don't know how to "manage their finances," etc. This person's name is Susan Hunt, her phone number in Irving, TX is 1-800-922-4684. Her fax is 1-713-336-4301. I also filed a complaint with the Comptroller of the Currency (you can do this via their website, by telephone or by mail). I would also suggest you contact the following: The Better Business Bureau; the SEC; your local Attorney General; your State's****.!!!
