This is an email I sent to Florida Politians -- hoping that someone do something -- I also included various reports I found online.

I am writing to you for your help assistance or any form of involvement to negotiate or transact with Wells Fargo's Loss Mitigation department.... I am getting all kinds of misinformation from them and am afraid of losing my home because of their lack of consistency, ethics, incompetence or whatever it be... It seems they are stringing me along until I am faced with a foreclosure.. I did some research on the web and found this to be the case in many instances with other homeowners, Web print outs have been attached for your review.

Brief Summary:
My wife had some unexpected medical issues with her heart which caused us to fall behind on our mortgage due to increased medical expenses.I contacted Wells Fargo in July 2008 and explained our circumstances and they explained that we could possible qualify for a
loan modification...

On July 31, 2008, I spoke with Angela and gave her all our financial information over the phone. She said that based on that we may qualify for a loan modification but it would still have to go for review with a negotiator. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION.

On August 19, 2008, I spoke with Maura and being that I had not heard anything, she said that it was pending and there was no further information available and to keep calling back. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION.

On Sept 2, 2008 received a voice message from Jeff Cunningham...

On Sept 4, 2008 returned the call and spoke with Susie and she told me that the expenses had to be reviewed and if there was any changes... I said no everything was the same.. She further informed me that this would be sent to Jeff Cunningham and to call back in a week to get the status of the loan modification. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION.

On Sept 12, 2008 received another voice message from Jeff Cunningham

On Sept 16, 2008 returned the call and spoke with Bryson and he requested information on the taxes and insurance of the home. Again I gave them the monthly allocation for both... He said the call back in a couple of days for the status. I ASKED IF I SHOULD MAKE A PAYMENT, HE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION.

on Sept 19, 2008 I called to further inquire and spoke with Tameka, she again said it was in review and reviewed my financials again and asked about the taxes and insurance... Told her everything was the same. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION. She said to call back in a couple of
days.

On Sept 22, 2008 received a voice message from Jeff Cunningham

On Sept 24, 2008 returned the call and spoke to Jasmine. I also mentioned that I received a letter stating that the loan modification was denied. She informed that there was a deficency that the expenses were greater than the income as per the credit report... I further reviewed the info with her and explained that I had cosigned for family on those particular loans but was not making nor financially responsible for the payments. She said she would remove them which gave us a positive cash flow of $550+ per month and forward the info to the negotiator Jeff Cunningham. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION. She said to call back in a few days to get the status.

On Oct 3, 2008 - I called to inquire on the status and spoke with Victoria she informed me that the modification was denied for a deficit.. I explained to her my previous conversation with Jasmine. She informs me that the information was not saved in the system. I again furnish her all the same info and she assures me that the info was saved and to callback on Saturday. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION.

On Oct 4, 2008 Saturday, I spoke with Raenne, she again tells me that the info was not saved in the system and I again informed her of my conversation with Victoria and again informs me that the information was not saved again I give her all the info. She tells me that I qualify for a loan modification and need to make a payment of $1800 by Oct 14, 2008 but does not have the details of the terms. That I will receive them within 10 days.. I explain that I can't I accept something without getting full disclosures of the terms.. I told her that I would discuss it with my wife and get back to them on Monday which she informs me that the $1800 payment would be required 10 days from the date I accept these "***" terms which of course she does not have any details... I was completely perplexed because of my previous conversation Victoria assured me the the info was saved.

On Oct 7, 2008 I call again and speak with Victoria (same person as on Oct 3, 2008). She informs that what Raenne told me was all wrong that she must not have seen the our loan modification was reactivated and still in review. Furthermore she said that after our conversation on friday she checked the system and all the info was saved and negotiator was reviewing our file. I ASKED IF I SHOULD MAKE A PAYMENT, SHE INFORMED NOT TO THAT IT WOULD AFFECT THE LOAN MODIFICATION. She further informs me to call back on friday that I should have a response/resolution on my loan modification by then.

On Oct 8, 2008 I receive a package from process server.. As I open the package I am dumb founded to see a demand notice from an Attorney notifying me that my home is in foreclosure... All this time while I was under the impression that they were supposedly working on a loan modification to save my home.... they were actually processing it for foreclosure.... Which further perpetuates the increasing expenses.

On 10/10/08 called Wells Fargo to get status on my Loan Modification only to find out that NOTHING has been done. I received foreclosure notice yesterday as I mentioned previously. They just strung me along to process a FORECLOSURE.

Spoke with Steve, I asked if I could record the conversation and of course he disapproved. I asked to speak to supervisor and transferred me to the Loss Mitigation dept.

Sabrina got on the phone. Said she was a loan specialist, I answered what does that mean she answered someone that can help me. My response was that I thought that is what I was doing since July 2008 with all the other people I spoke with there. All she could answer was that she apologized and can only be accountable for her actions. Now she mentions that I need to fax all information to them because this is what the investor requires... I said granted but why did they not tell me this when I first spoke with them. She said she understood but can only answer for herself. I asked about the foreclosure and the additional fees. She responded that the fees would be part of the loan modification but if I got her the documentation she requested by Tuesday, it would hold of the foreclosure and to have at least two mortgage payments when loan was approved for modification. To call Back within 72 hours to confirm that the fax was received.

Once bitten twice shy.... What assurance do I have that this time they will do as they said... I am dealing with the same people mentioned in the reports I attached...Do I have I choice, no I have to continue on this endeavor and hope and pray that they will do as they say....

Someone has to get involved when Corporate America acts in this manner with its consumers.

This is fraudulent and deceptive business practice.... Stringing me along for the long haul to foreclosure.... All they had to say from the beginning is that I must make my payment and no loan modification will be done... I would have found a way to pay the month and a half I was behind not lead me to believe that they were working to help me restructure my loan...

PLEASE HELP -- I AM IN DIRE STRAITS -- AND I AM SURE OTHER FLORIDIANS ARE IN SAME OR SIMULAR SITUATIONS --

If this is also the case with other lenders, this inflating bubble is going to burst in the worst possible way. Property values in Florida will not only decrease further but plummet. This will further cause unemployment to double digits, increase crime, poverty will be similar to those from the great depression. No jobs no money, no money no consumption, no consumption no jobs, ..... get the picture... Domino affect.... Downward spiral.... Where is this $700 billion bailout coming from.... taxpayers??? But who bails them out!!! You cant get water from stone.... If taxpayers are not working no taxes and if no taxes no money for bail out!!!!.... Again where is it coming from???

Thank you in advance for your time, efforts, assistance, consideration and cooperation in helping me and Florida ride this ride this catastrophic wave...

Since I received a Foreclosure Notice, I must respond which I will and am also including this email and all the reports I found on the web and am recording it the courts so if and when the time comes before the Judge he can see it too!!!

I have just read the report from Flordia by the person name Javier and your story was identical to my story. I am fighting the fight of my life and was ready to have a nervous breakdown. I also wrote the governor in the State of Washington. Was transferred to the Department of Financial Institutions and now my complaint was sent to the OCC (Office of the Control for Currency or something like that).

I have been fighting with Wells Fargo since March 2008. My house is schedule to auctioned off this month and we are fighting to stop the Foreclosure. I was already on a Repayment Plan and later got deleted from the system and had to start over with Loss Mitigation. I was also told NOT to make payments. The review periods are 90+ days so you can imagine how far behind they are reporting us on our payments. Our credit is being destroyed.

Has anyone that has filed a report been able to resolve this issue? Has anyone found an attorney to step in? I have 30+ pages of documentation for every phone call I have made to Loss Mitigation, Collections, Liquidation Department, Written Correspondence, Disaster Team (we fell behind due to a FEMA declared Disaster), and Foreclosure Department Liason.

Anyone out there with additional information or additional resources, please let me know. Wells Fargo is sending out press releases that they are leading the way with saving people's homes and now they have merged with Wachovia and have expidited/streamlined processes to Modify loans and save homes. I have yet to see any action on ours. After 3 loan Mod. approvals, we are back in review but we are still active Foreclosure. I do not want my family to be homeless. We were denied for a Loan Mod last year due to "insufficient income." It took me 30 days to figure out what happened and I found out the Negotiator "mis-read" our financials and "mis-calculated" our income. It took me another month of fighting to get back to that department showing we had sufficient income.

Please help or send resources if you have had success or have legal representation. We would love to join you in this fight of our lives!

The exact same thing happened to me. This is a crime. What can we do? Congress, lawyer, burn the place down?

Wells Fargo must have a script. They are all using the same language.

Javier, a couple of things:

1. Small thing, but you ARE financially responsible when you co-sign a loan, that's the whole point. If your family member who you co-signed with cant make a payment, YOU will be getting collection calls as well.
2. Servicers (WFHM in this case) are REQUIRED (by the investor, or owner' of your loan) to process the foreclosure after a certain number of days you are in delinquency.

This is a big difference many people do not understand WFHM is responsible for servicing your loan, collecting your payments, etc; they do not own' your loan. Actually, the government likely does if you have an FHA, VA or other standard product loan, and THEY set those foreclosure time requirements (or even if you have a non-standard product, the loan is likely owned by a private investor who has similar requirements). WFHM makes a servicing fee every time you make a payment (a piece of the interest) so actually, WFHM has a vested interest in your financial health and you keeping your loan (I know, it's hard to believe sometimes).

THUS, they MUST process the foreclosure, even if working on the loan modification at the same time (which is very normal).

The fact is WFHM is one of the biggest servicers of loans in the US and there are millions of people struggling right now, no one will have a perfect experience. I know that doesn't help a lot, but maybe it can help to put things in perspective.

Here's what I suggest:

1. Continue to escalate your issue when you call in to WFHM (e.g., ask for a supervisor).
2. When you call in, inquire about the various government programs that suspend foreclosure while borrowers are attempting to work on loan modification plans, etc. Ask if you are eligible. (Programs such as HOPENOW (hopenow.com), Hope for Homeowners)
3. Whatever you do, stay in contact with WFHM they are obliged to do nothing if they cannot reach you.
4. Keeping asking about the loan modification and what is needed to get it done. Be patient, be methodical, keep trying.
5. Write a RESPA letter about your problem (RESPA, or the Real Estate Settlement and Procedures Act, requires servicers to address your written complaints within 60 days, and if they cannot do it in the first 20 days, to send you at least a letter acknowledging your written complaint) - (Google respa letter' it's the first result). Written (it MUST be written) RESPA letters receive the highest attention by servicers.
6. As the RESPA letter indicates, you SHOULD continue to make the required mortgage and escrow payment until the request is resolved (c'mon, it's just common sense!).

Your story is almost exactly like ours, except for your wife's heart problems (sorry to hear).
We have been going through the exact same thing. They have been stringing us along for months,adding more and more fees (we are around 20,000 now)while awaiting our "loan modification" which when they finally sent it was more than our current payment which we could no longer afford. RI Housing has been dealing with Wells on our behalf and is trying to get them to accept us under the Hope for Home owners program which they claim they are participating in but yet are now "sitting" on this again (bringing it to their investors). Today I receive another lawyers letter stating our home is going to Foreclosure sale on 1/23! How do you tell 3 young kids that we have to leave the only home they've known and leave their school and friends?
I have no idea when this nightmare is going to end! I'd get into all the sordid details of my dealings with them but I'm just too tired to go through it all again. Just know that you are definately not alone.
What is President Obama going to do with all of us homeless Americans????

In July I was a month behind in payments on our home mortage. I did request for a Loan Modification and it went to Loss Mitigation on Aug 28, 2008.

I would contact WFHM after they left messages, and I was also told not to make payments because it would affect the loan modification (which wold drive me crazy because all it was doing was causing me to get futher behind).

Oct. 21 I was on the phone with WFHM and they informed me that my house went into forceclosurer on Oct. 20. I was sickened because I explained to her that I applies for a loan modfication in August this girl was talking so fast she could not let me get a word in at all. I again asked can I please make a payment. No, I was told again because it would affect the loan modification. On Oct. 22 I received a letter from attorney Pierce and Associates from Chicago about information about the foreclosing proceedings.

Oct. 24 Scared to death, suicidal and worried I went to a Consumer Credit Counseling Agency to speak with them and to beg for help. The lady representing the Consumer Credit Counseling agency helped me again fill out loan modification forms and she faxed them to WFHM and I certified mail the same copies. I called on Oct 28 to ask if they recived the information and of course they only received part of the fax, so I faxed the information again on Oct. 28.
I called again on Oct. 31 spoke with Keisha in customer service she then transfered me to Tamika a borrower counseling rep and I ask her if they finally received the information and yes they did. She stated that it could take up to 45 days to review it. Keep checking on the status and of course no I can not send any money to them. She then goes on to tell me that I am now four months behind July, Augusy, September and October. I then told yes I know because of your customer service department I filed for a loan modification in July, it went into mitigation in August and then I was told not to make payments ( I could of been caught up by now on my own). She did not know what to say, I told her yes your company is the cause for my foreclosurer. She then checked the computer verified that the loan modification has been sitting there since Aug 28, 2008. She emailed Ryan Wunderlich for him to review the modification quickly.

Nov. 3 I received another letter from Pierce and Associates that they were hired by WFHM to commence foreclsoing proceedings.

Nov. 7 I called WFHM to check my status for the week. I spoke with Beverly in Loss Mitigation and she told me that on Nov 5 I was approved for a Loan Modification to begin on Jan 1, 2009. Great I love Beverly. She explained I will be getting the paperwork delivered and to sign it and send it back. I asked her if the foreclose has been stopped and she replied yes.

I thought it was all over I thought I could live my life again.........

On Nov 10 received yet another letter from Pierce and Associates expaling that I need to get in touch with WFHM to set up a re-payment plan of some sorts.

Nov. 14, 2008 received the package delivered by DHL from WFHM read over the papers same amount etc. Signed the papers. Dropped the papes off at the UPS drop box up the road from the next morning (Sat. Nov. 15 9am).

Nov. 22, 2008 the sheriffs department arrived at my house at 1:22 to serve foreclose papers on my husband and I. (thank god our son was not home)

Now I have 30 days to file.

I am at a lost for words. I am scared to death that I am going to loose my home all because of customer service reps. telling me not to make a payment. I explained to Tamika that I could of had this resolved myself two months ago, but since their reps told me that I was not allowed to make payments I am in a bigger, more expensive mess.

I don't know what to do, except to miss work monday start with calling WFHM, then Pierce and Associates, and then going to the local court house to file that I am contesting the foreclose.

I hope no one else will ever go through this mess. I am sicken. This has played on my emotional state.

I actually came to this site today to check on another company, however I was shocked when I came across all the complaints filed against Wells Fargo Home Mortgage.

The same tactics and false promises have and are happening to us. This cannot be coincidental. There has to be something that can be done about this!! In all the complaints I have read today, the process for short sale and foreclosures with Wells Fargo are the same.

This started in September of 2007, we got behind 2 1/2 months on our mortgage, however, we caught up in January 2008 and payment was accepted, also made all payments on time after that. It was not until the last part of May 2008 that we were informed that they had filed foreclosure documents and we owed them an additional $4,900.00, plus attorneys fees in excess of $6,000.00.

To make a long story short, same process is happening to us as everyone else has described, numerous phone calls, never the same person. Promises and return communications never kept. All documents requested from Wells Fargo we supplied,
also was told not to make any further payments, while the whole time we owed more and more money with late fees etc.

And needless to say the nightmare goes on. We all need to ban together and stop Wells Fargo from removing families from their home by unethical and surely unlawful
practices in order for them to fatten their pockets.

There is an attorney who is contemplating a class action against wells fargo, His name is Miles Brasches send any documentation you have to 1887 Wingate, Bloomfield Hills, Il 48302 his email is MEB101331@aol.com.

Wells Fargo has done the same thing to me, I have done everything they told me to do, but when I have questions there is no one to answer them at Wells Fargo.

I fell your pain. I bet you are not backward on your loan (the home is still worth pretty much what the loan is). It seems to me that these are the loans they are pushing to foreclose on, then they can still get their money. The funny thing is they WOULD get the mortgage payments if they just worked with people!
The same thing happened to me. Every time Wells Fargo said they were working on a modification it took forever, and then I was denied. My husbands work causes him to have alot of w-2's with a lot of different employers. It is the same job he had when we got the loan, but because of this they "couldn't verify income" so the loan modification fell through and we got further behind. (The job was good enough to get the loan, what changed?)
I turned my information over to the OCC (the government overseer of banks). They act as a go between between myself and Wells Fargo. I am hoping we can get something resolved with this loan. I think you need to get someone like them involved. If nothing else, they can't keep playing dumb like they never made promises,and you deal with one person, not a new person every time, who won't follow through on the previous persons promise or conversation. They have to give the OCC a copy of everything they send you, so at least you have back-up and consistency. I hope this might help
