We mutually agreed on a price and then signed an agreement that stated that the flooring project at my home would cost a total of $9,500. (I agreed to this price because it was the lowest bid that I had received). Simultaneously, I delivered a check in the amount of $6,500 as a deposit towards the flooring project. $3,000 was to be paid upon completion of the flooring project.
 
Within a few days, she began to demand more money for the completion of the project.  At the present time,  she is demanding at least an additional $3,495, a 37% increase from the contract price. Moreover, the project has not commenced, nor is is scheduled to commence for another ten days at minimum.
 
We are not in the position to pay more than the original agreement price of $9,500.  As such, we gave notice that our contact is now terminated, and the full amount of $6,500 shall be returned to me.
 
Sheyla Morales has now told us that she does not have the money to return to us and that we have to go to court to retrieve it.
