FIFTH THIRD BANK PADMAJA SHENDURE verified fraudulent cashiers check from 5/3 bank was good and i could cash it. the check was in fact fraudulent. solon, Ohio

On 1-25-13 i applied for a job online for a personal assisant On 1-27-13 i was emailed i got the job and would receive my first assignment in a couple days. On 2-1-13 i got an email that i would be receiving a cashiers check for $2460.00 and my first assignment via fedex overnight. Later that day i did get the fedex delivery w/ the cashiers check enclosed. I was very skeptical and aware of scams involving things like this. So i took the check before i did anything explained in the assignment to a local fifth third bank branch to have them verify the check was good and it was not a scam. Padjama shendure ( lead customer service representative) took the check and punched something into her computer, after a few minutes she said its from our bank it is good, and do i want to cash it or open an account and deposit it. I didnt have alot of time, so i said no can i cash it at my bank up the street where i have my accounts. She said yes the check is good. I went to my bank and cashed it, then went immediately to follow the instructions given me in the fedex envelope with the check. ( i was to pay a bill for my boss) and keep the remaining $500.00 for my first 2 weeks pay. So i went to western union and sent $1950.74 as instructed to pay the bill. After a few days i got a call from my bank telling me that the check i cashed was fraudulent and im responsible for paying back the full amount.

I was so blown away and shocked as it was verified as good by fifth third. After i calmed down i filed a police report and went to fifth third and told them what happened and wanted them to pay for it as they verified it as a good check from their bank. I was told by the manager that they cannot verify a check good or bad even if it is from their bank, and they are not responsible. I couldnt say anything i was so stunned. I ended up paying my bank back with my own money. This is not right. It was a fifth third bank cashiers check verified by them. I did all the right things taking there for verification. And im stuck with paying for a fraudulent check.

But you are going to end up being responsible for the money.

I can't tell you exactly what the teller did, but most likely she only had access to if the check was issued.  It is not until it is presented for payment that it can be verified as good.  It could be a case that in that couple of days it was reported stolen, the "real" check could have been cashed or any other of a dozen different scenarios.   Just be glad you cashed it at your bank and not at 5/3 because 5/3 would probably have had you charged with check fraud in addition to wanting the money back.

Now, if you don't pay the money back.  Your current bank will close your account and turn you over to ChexSystems.  What this does is in effect make it impossible for you to open a regular account at another bank for many years to come.  You also are going to open yourself up to a lawsuit from the bank, and because you are responsible for any check you attempt to deposit..you will have a judgement against you.

Also, the fact is that you had a feeling it was a scam but let your "greed" get the best of you.  Do you really think that someone is going to pay you $500 for what turned out to be about 30 minutes worth of work?   Even if he had you do that once a day for 10 days(2 weeks) that is still only about 5 hours of work.  That works out to $100/hr.  Do you really think what you did is worth $100/hr?

Not only that but all over the Western Union forms there are warnings of this exact scam..yet you ignored those as well.

The bank will not know the check is fruadulent until it is cashed and the account holder disputes the withdrawal.  I witnessed this from a company that had checks stolen and cashed.  The monies stolen was replaced by the bank after they paid out to the thief.  If the person cashing the check uses fake ID then there is no way to recoup the monies but, if the person cashing the check uses a real ID then they are liable to pay back the bank and face possible charges.

This is a common scam - guess you did not research this very well.  The bank has every right to recoup their loss.  Lesson learned and place blame where blame lies with you.
