Fairbanks Capital Corporation ripoff Salt Lake City Utah

I posted some reports re: Fairbanks Capital, when they were falsely trying to foreclose on my home in Arlington, Texas. I received no help from any of the government agencies or law firms contacted. As it turned out, I ended up selling my home a year ago because I was beaten into the ground trying to fight Fairbanks. I could no longer afford wasted attorney fees and was crazy from running up against brick walls everytime I tried desperately to save my home. After 25 years of living in my home I sold it and ended up with LESS THAN $10,000.00, in equity. My equity SHOULD HAVE BEEN over $70,000.00!!! I really think in my state of mind, I would have burned the thing to the ground BEFORE I would have let Fairbanks take it!!! I'm posting now to just update my situation caused by Fairbanks. I ended up moving to Colorado to be closer to my daughter and grandchildren. Will I EVER receive the monies Fairbanks owes me? NO! I am out (because of attorney fees and monies paid to Fairbanks for payments and penalties PAID TWICE, court fees, attorneys, etc.) well over$100,000.00! I have no savings left and am scraping by now. My life was ruined by Fairbanks! A home that I loved and was nearly paid for was all taken from me and NOT ONE PERSON OR AGENCY cared or helped me. I'm still very bitter and hurt over the years of hell I spent fighting Fairbanks. I said they would NEVER win, but they did in the end. I pray that someday, some way I might still be able to claim my monies owed, but think I have a better chance of winning the lotto! (Yea right!)
My thoughts and prayers are with the people that have suffered as I have and for those still tangled in the messes created by this fraudulent company.

please dont give up. thats what they want if everyone gives up look at the homes they can resell and make money off of. you have done half the battle and if you have to refile the bankruptcy to keep your home do it. that 3600 will not take long in a 13 and if you have to stretch it out for 5 more years and at least you know that you have 5 years to do something a lot can happen in 5 years.

somebody might just give fairbanks what they deserve. and if we all keep fighting somebody is going to have to do something. i think the best chance we have is the news stations because they love scandal. so start writing to your news stations and once they start looking steer them to the web site so they can see all the horror stories and i think that will be a start.

i am going to write the news right now they all have web sites that you can file your complaint right on line. I am in my last days before foreclosure but i will wait until the last day and if i have to i will file chapter 13 again. what ever i can do to hold them up and create havoc for them i will do. we need you to help us fight so lets get busy.

remember God is in charge not fairbanks and he has the last call on who leaves their home and who stays. just keep praying it does work. you might not think so but it does when two or more come together in prayer it is more powerful than fairbanks. we all prayed for something to happen and the lawsuit happened now we have to pray for them to be gone.

I received a check from the fund for 386.00 what is that compared to the money they have stolen from us. the mere fact that they are paying out money lets you know that they have done wrong and this is hush money for ftc, hud, and fannie mae. I say we call channel 2 news, and every news station in your state we have to do this all together. everyone from every state needs to write the news stations the news papers, hud, fannie mae, ftc all the state senators, all the elected officials that we can stir up some rucus until some one listen to us. if every one will send the names of your radio tv, and news papers to everyone we can get started. the best news stations in chicago are channel 2 (cbs) channel 5 (nbc) fox news (fox)

Some time last year I did a rip-off report we have been in litigations with this company since that time. I know there is NO lawyers, NO judges or anyone in the state of Florida that cares what happens to the AMERICAN people. They could care less if we have homes to live in or not. We have made a decission to allow FAIRBANKS to forclose on our home, we are tired of fighting.

We have lived in our home for 20 years and have paid for it one time and was paying for it again due to refinancing to have necessary work done on the home. It has been a nightmare for me and my family but we have given up. My husband served 21 years in the military in which he served in Dessert Storm, his only reward is that the American people has allowed this company to take everything he has worked for. I do agree that these people are part of the regime. I do know beyond a shadow of a doubt that foreign people are working desperatly to take what the American people have worked for.

This company is simply a part the war we are currenly fighting at this time. No this company hasn't bombed our homes but they don't have to, they simple take them from us. I am a christian lady and I have faithfully been praying for this situation. I do wish anyone who reads this to continue praying for this because you are aware these people are simply the ANTICHRIST. Nancy, I wanted to respond to your posting. My family and I are also victims of Fairbanks/Select Portfolio. (see my posting dated 10/1/2003)

You mentioned that you will have to file Bankruptcy to save your home. Five years ago we filed Chapt 13 and it does NOT save your home. Filing a Chapt 13 will place an Automatic Stay on the foreclosure and prolong it, but it will NOT stop it! I have found this out. Our Chapt 13 will be done in Sept 2004. The Foreclosure is only null and void if ALL back monies are paid in full by the time your Plan is concluded. If any back amounts remain unpaid by the Plans end, the foreclosure proceeding started before the Plan can now be continued where it left off. If you were dealing with any other bank, you probably would have paid all back monies and could move on with life. Unfortunately, the realization is, we are dealing with Fairbanks/Select Portfolio.

This is exactly where we are at right now. Fairbanks/Select Portfolio states we owe $3600.00 in back Escrow. Once they receive the notice from the courts that we have concluded our Chapt 13, they can and probably will continue with the Foreclosure that was put on hold 5 years ago. Please note, the $3600.00 is the only amount we know of as of now. I'm sure once we are no longer under the protection of the courts, that amount will change and will all of a sudden become an amount that they know we would not be able to come up with to save our home. We are right back where we started 5 years ago. I have contacted my Bankruptcy attorney and like Fairbanks, I have found he just wants my money. His suggestion, think about re-filing or start looking for someone to re-finance with.

We did set up a consultation with a reputable attorney, he gave us a few suggestions for laying some groundwork. First, we needed to have our Mortgage Audited by a CPA. You need to have "expert" evidence when you go to court. Second, create a paper trail. Document everything! Print articles from Newspapers, Internet sites, the FTC site. Tape record phone conversations. Send all letters, checks certified mail. (Basically...Cover YOUR BUTT!!) Third, write to and send a copy of your files to every Congressmen and Senator in every state they have an address in. Write to the FTC, The Better Business, The U.S. Banking and the U.S. Federal Court and each Attorney General that they have an address in.

Having said all of that, now let me say, it basically does not a d**n of good. We did all of it...every bit of it! This is the outcome we received. The Florida and Utah Senators and Congressmen acknowledge receipt but then state they have forwarded it on to MY state Congressmen & Senators for review. The FTC and The BBB will give you a case# and acknowledge receipt and will then request a rebuttal from Fairbanks/Select Portfolio. Once that rebuttal is received, they will then send you a letter stating they are closing the case as a response has been received. Fairbanks did respond. It is a very generic response and does NOT explain any of the EXTRA charges, how they come up with these figures etc. If the FTC or the BBB took the time and read or examined any of the paperwork that was sent, they would have seen, nothing was answered.

No resolution has been received from any of these departments that are supposedly here to help US, the consumer.

I have not been able to find ONE attorney in New York that will take this case. As with you Nancy, the attorneys we have spoken too have never heard of this company and they look at you like you are the lier and that what you are going through is just too outrageous to be true. Yet none of them seem to be interested in the huge file box that I carry around with this extensive paper trail.

We have been trying to re-finance. Again, Fairbanks/Select Portfolio has us listed so far behind that it isn't even the Bankruptcy that bothers the finance companies. It's the months past due that is shown. Yet, WE AREN'T PAST DUE!!

September is just around the corner. Losing our home is inevitable. I'm slowly coming to the realization of that. What I am having most difficulty with every day is how I am going to explain to my two small children why they might not go to the same school because we might have to move out of our school district. Why we have to get rid of the cat and dog because we can't have them in an apartment and why they no longer have their own rooms or a yard because most apartments don't have those luxuries. I am thankful for what I do have and that is my family. But my children don't understand that yet, their home, their friends...that is their security.
