Making the fine print BIGGER that's RESPONSIBLE BUSINESS.

We had been with another Credit Card Processing company for many years. I would not have switched companies except that, the company the salesman represented was QUICK BOOKS/INTUIT. IMS is a subsidary of INTUIT. Every bit of material he displayed had the QB/Intuit logo on them. Because I've been using Quick Books for well over a decade, and his good sales approach, I switched (over the objection of my wife).

We were with that company for a year or more (don't have the info available). Our old provider's representative stopped in from time to time (ashealways did) and showed me some of the sales techniques IMS does; and how they hide various charges. Once I saw this clearly, I switched back. But even then, I waited for about 2 months to see how things shook out. Finally, today (Jan 8, 2008) I called IMS to cancel. It was then that I was TOTALLY SHOCKED AND ANGRY THAT they would add insult to injury by applying a "fine print" element of the contract that allows them to APPLY A A $295.00 CANCELLATION PENALTY to my account!

This is TOTALLY OUTRAGEOUS.

I should know better that the sales reps are eager to get a signature RIGHT AWAY.

I should know better that their sales reps are NOT INCLINED to POINT OUT something as important as the CENCELLATION PENALTY when they sign up new customers, like me and thousands of others.

I should not expect .. that there are ETHICS involved in business. Where ARE THEIR ETHICS?

I have used QB-Pro and Turbo Tax for over 15 years. I trust that company.

A Cancellation penalty is unreasonable, unfair and wrong, sir or Madame. For that matter, so is a "Minimum Monthly Fee" and a "Customer Service Fee" especially when there is INACTIVITY ON THE ACCOUNT. What excactly do they do except send out a mass mailing of billing statements.

If this company follows through with this $295 PENALTY for my "Mom & Pop" business ... then I call this WHITE COLLAR CRIME Sure, its probably legal, but ...

Is it ethical?

if they do in fact intend to carry that out, I did ask for a RESPONSIBLE representive from INTUIT / QUICK BOOKS / INNOVATIVE MERCHANT SOLUTIONS to explain (Justify) the basis for this. How can they possibly justify tacking on monthly fees, processing fees, minimum processing fees, manual input fees, etc, and still make more money off poor, unsuspecting slobs (like me) by effecting a CANCELLATION FEE.

You don't know how angry I am.

BOTTOM LINE: I ask all persons considering using QUICK BOOKS/INTUIT/INNOVATIVE MERCHANT SOLUTIONS to

BEWARE THE LEGAL WHITE COLLAR CRIMINALS at this firm.

In summary,

They are LEGAL CROOKS. THEY HAVE NO ETHICS. THEY LOOK FOR CLEVER WAYS TO CHEAT UNSUSPECTING CUSTOMERS.

SHAME ON YOU, QUICK BOOKS.

SHAME ON YOU, INTUIT.

SHAME ON HYOU, INNOVATIVE MERCHANT SOLUTIONS.

The "fine print" you refer to is a section directly above your signature in BLUE TYPE that states "Only sign this application if you are applying for new credit card processing with IMS. If the Merchant Account is signed and Approved by IMS/Bank, and Merchant exercises its options at Merchant's own discretion to terminate the Merchant Agreement, Merchant will be charged a $295 Termination Fee."

This printing is less than 1/2" above your signature on the contract, therefore would not be considered hidden. A copy of your application will be sent to you for your review.

You have also mentioned the Minimum Monthly Fee and the Customer Service Fee. The Minimum Monthly fee is charged if you do not have any sales. That is the nature of the fee. As you process, your processing fees are deducted from the minimum and reduce it by that amount up and until it is zero. Then you are charged just your processing fees and not the minimum. That's why it's called a minimum, as that is the least amount you will be charged. This is likened to a utility like a phone service....whether you use the phone or not, you're charged the monthly fee.

as a customer of Innovative Merchant Solutions, I have had difficulties in getting their customer service department to assist me in resolving problems. I've had customers whose cards were authorized and they walked out of my store with their merchandise, only to discover a few days later when the batch cleared the bank, that an entire transaction was missing from the batch. I've also had customers charged for two identical transactions... It takes weeks for them to clear these issues up, and then they can offer no explanation as to why it occurred or what I can do differently in the future to prevent it. It's extremely frustrating trying to track a customer down to get their credit card number from them because their card wasn't actually charged at the time of their purchase.
