As a customer I am very upset about what I have discovered regarding my new pool sanitization company. I purchased one of their products a little while ago and now I find this:


Ecosmarte Planet Friendly has filed Chapter 11 Bankruptcy On June 2, 2009, the company filed for reorganization under Chapter 11 of the federal Bankruptcy Act, case number 09-43569.


Those with monetary claims against the company are advised to obtain a Proof of Claim form by writing to Minnesota Bankruptcy Court CM/ECF, 300 S 4th St, Minneapolis, MN, 55415 for resubmission to that court.

 You would think that a company who is potentially going out of business would notify their customers the 5 year warranty may end in a few months...


If I had known this before I bought one of their systems I would have gone (RAN) in a different direction.

unfortunately many companies have been in Ch 11 Bankruptcy the last 2 years.  what many may not understand is Ch. 11 is a reorganization of the company.  it does not mean the company is going out of business.  every major airline and all the auto manufacturers are still around after being in Ch. 11.  Ecosmarte currently has a plan submitted with the court and expects to be out of Ch. 11 by the middle of March stronger than ever.

it is also important to point out that sites like this allow competitors to make up stories pretending to be consumers with problems.  anyone listing themselves as anonymous is a pretty good clue that this is an attempt by a competitor to try to discredit us.  the tag line listing specific search terms to try to get this out also points out that this is not from a real person with a legitimate concern.
