asset acceptance filed a court lawsuit on one debt over 12 years old. they without authorization obtained my credit report to see if I have any new credit. then they proceeded to call me over and over and over again. i explained to them that was an old debt which doesnt appear on trw, experian and the such. they then sent me a summons and i replied and it was not within the 21 days. they submitted to me 1 week before expiration. they got a judgement and then filed a judgement lein against any new property they can cease to pay a debt of $2,686.21.

this is wrong and illegal... my family is in the process of suing someone related to our family and a friend that runs or works in the warren office is acting on the friends advice and resurfaced this information. mark valvano of asset acceptance is friends to the person they are sueing...this wrong and illegal what can we do. Now another bill from 11 years ago now surfaced from this same company for $4,548.39 this company should me closed down a complaint has been filed with the state of michigan, the attorney generals office, chamber of commerce, and whom ever I can find... none of this is on my trw it was erased and now resurfaced....

First of all, they do not need YOUR authorization to pull your credit. They meet the "permissable purpose" requirements.

Second, the 7 year credit reporting has nothing at all to do with debt collections. Just because something is off your credit report, does not mean it cannot be collected.

Every state has a Statute of Limitations, and in MI it is 6 years for any type of consumer debt.

You really need to go to the FTC website and print out and read the FCRA & the FDCPA. Also go to budhibbs.com and look for the link to the NACA to get a lawyer either free or cheap that specializes in debt collections.

File FTC complaints against the collector for collecting time barred debts. Do this online.

On your current judgement, you need a lawyer to file a stay of judgement and explain the debt was not legally collectable due to expired SOL.

On the second one you need to send a written dispute of debt and cite the SOL expiration.

Do not communicate over the phone, do everything in writing. Send all mail certified, return reciept requested and put the certified# on the letter itself and be sure to keep a copy for your records.

Just because you know the debt is old and/or uncollectable, does not mean you can just igmore time sensitive actions against you. That is the only reason they got the judgement, and that is what they count on.
