Through a series of bank mergers we currently have Bank of America. Every time the banks merged the fees seemed to increase. Recently we went on vacation from Dec 24 - Jan 1. My husband has automatic deposit and receives a check every Thur. He neglected to tell me that his Dec 27 check was deposited 2 weeks early.

On Dec 24, I checked my balance and had adequate funds to cover any pending checks. I wrongly assumed that there would be another check deposited on Dec 27. While on vacation (all the way across the country in CA) I used my debit card several times to pay for food and receive cash back. Never was my card denied because of lack of funds. When we returned on Jan 1 there were no notices of overdraft. On Jan 3. my husband's weekly check was deposited as normal. At this point I assumed that there was plenty of money in the account - Little did I know that this check was completely used up for the past debits, scheduled checks and 5 overdraft fees of $35. each, which put each new purchase and check into overdraft again.

I had the first inkling on of a problem on Sat, Jan 5 when my husband went to the bank to withdraw funds and called to ask me why we were $200 in the hole. He thought that perhaps there was a problem with the Jan 3 automatic deposit. I went to the bank and verified that this check was received not realizing that it was the Dec 27 check that was missing. I could not understand what had happened. At this point I put a check in for $400 drawn from a local credit union. I went home to sift through my account as to the problem.

By the time I had figured out the mistake, it was after business hours on Sat. I went to the bank and deposited another $1000 from the local credit union. The bank of course did not credit that amount until Tues or later and I continued to accumulate overdraft fees. I did not receive my first notice of overdraft until Jan 8, over a week after the initial problem occurred. I landed up with 12 overdraft charges of $35 ($420)

I am not denying that the initial mistake was mine. What makes me furious is that they would put through debit card purchases with a negative balance in the first place. And also since they occurred in a location 3000 miles from my home, I am surprised that they would not flag these transactions as possible fraud and notify me. (I have had my credit union debit card pegged for possible fraud for much lesser things)

Also they took over a week to let me know of the first overdrafts thus not giving me timely notice to take care of the problem and avoid the many additional future overdrafts that occurred. And when I did deposit money to cover the overdrafts the money was not credited immediately, When I complained to the bank they refunded a measly $113 out of the $400.

BTW I used to have an overdraft protection account with the bank. Because my husband had a long period of unemployment we had run up our credit cards and had some late payments. Bank of America canceled our overdraft protection yet they had no problem advancing us over $1000 for overdrafts when they could collect $35 each time they made an advance (and some of the advances were only $20)

Overdraft Fees Info. and Acct Owner Responsibilities

As a Customer Service Rep., I totally realize your frustrartion with OD fees. However, as an account owner, your responsibility is to know what you have spent and how much money you have left in the account. The convenience of a check/debit card is obvious, however, most customers who make checkcard transactions DO NOT write their purchases in a checkbook/ledger, so you really have no idea how much money you have in your account. So, you have to rely on ATMs and the Automated system to get your balance, and those systems are handy for comparing balances with what you have calculated, or checking the amounts of your transactions, but perhaps you have made purchases that you think have already cleared but the merchant hasn't submitted the bill to the bank, then after you check the balance, those purchases come in and are deducted. Then when you make further purchases, you overdraft.

The transactions that are "PENDING" have ALREADY been deducted from your balance. When a transaction is in PENDING balance, that simply means that the amount has been deducted from your balance & put through the system, but it hasn't gone through a "processed". EVERY transaction (debits and credits) must go through a Pending state until the time of processing at the end of each workday.

Also, as for your deposits, made before the cut-off time on weekdays, will be added to your available balance after prosessing the next business day. The same applies for Checks that are not put on hold. If the deposit is made AFTER the cut-off time, it will not be processed that night, rather the night AFTER that. When checks are deposited FRIDAY, AFTER the cut off time, and are not put on hold, they will not be available until TUESDAY morning of the following week, since it will not process until Monday night. If possible, if you need money right away in the account, DEPOSIT CASH before the cut off time!!

I see SO MANY customers using their checkcard and not keeping a ledger/checkbook, and 99% of the time, they overdraft. A CHECKCARD purchase is just like writing a paper check!! Would you ever write a paper check and not write it in your checkbook and subtract that amount from your previous total? Probably not! Then why use a CHECKCARD for a purchase and not write it down? People who still use paper checks and keep a ledger hardly ever, if ever, overdraft. I'm not saying a checkcard is a bad thing, but it is used carelessly these days. JUST ALWAYS WRITE THOSE PURCHASES DOWN!! KEEP YOUR OWN RECORDS!!

Also, you allowed to make purchases when you are overdrawn because the bank thinks you are aware of how much money you have in the account, and when you use your checkcard, the bank sees that as a check coming through. If you write a merchant/store a "bad check" you are charged a fee by that merchant when the check is returned....right? Well, the bank is honoring that check and keeping you from "bouncing" that check and getting a merchant fee PLUS and overdraft fee, so yes, that is a courtesy!

I don't think it is possible for a check to deposit 2 weeks early. You stated that your husband has automatic deposit (direct deposit). How can something go through that the date hasn't hit yet? I know with Christmas some employers were depositing checks on Dec. 21st (this happened w/my wife and she would have been paid on X-Mas normally, every other Tues).

Also, do you have use online banking? If you did, you would have seen the balances. I know Bank of America has been known to give you a "buffer" in terms of check card purchases, but I am surprised you would be able to get cash back when the funds were not there. Also, being 3,000 miles is irrelvant. The only way a bank would consider something odd is if there is a big charge not in your home area. My wife and I went to Hawaii last April, used our check card all over the place, and we live in the DC area, not one call came from the bank. For the most part, it was small purchases. We also checked our account online daily (the resort had internet access).

A week sounds about right for the overdraft notices to come in the mail, since they do mail that stuff, but again, if you would have looked online, you would have seen this. You would have seen the early deposit too. It sounds like you keep a register, but why your husband didn't tell you about the early deposit isn't a good thing.

Depending on how you deposited the checks from the credit union will make a difference on when it posts. I know through it ATM it ends up being quicker than inside a branch, but if you went inside a branch, you would know based on the receipt when the check posts.
