If you are in the market for a car but you need a second change' type loan, DO NOT sign any contract or have any dealings with this company!!

To begin, I purchased a 2000 vehicle with a blue book value of around $3500.00 After financing with them, the car was $9800.00 with payments of over $200 every two weeks. Exactly 20 days after I purchased the car, the car broke down and I had to pay over $250 out my pocket to repair it. Two months after that, the car broke down again. Heritage Acceptance told me that they had a program where their mechanic can fix the car and I can finance the service. This ended up being $700 dollars which I had to pay and extra $50 on TOP of the already expensive car payment.

About two months later, the car broke down again and I kicked out another $350 for repairs. Then 30 days later, the car completely shut down. By this time I had stop making payments and I was tired of the lemon that I had in my possession. The last phone call from the company, I told them to come and get the vehicle. I was voluntarily surrendering the car. Now they are calling me and harassing me for payment. They are threatening to garnish my wages and they have even called my elderly parents to leave messages with them.

I have cleaned up my credit and they are the only ones that I owe but I am ready to file bankruptcy on them because I refuse to pay them one red cent for the piece of crap they financed.

You signed a contract with this apparent sub-prime lender because you have bad credit. When you turned in the car you agreed to a VOLUNTARY REPOSESSION, which has all the power and affect as if they came in the middle of the night and picked up the car without your knowledge. That does NOT end your contract obligations. You are STILL on the hook for what YOU AGREED to pay.

Nobody files a BK "on" anybody. Secondly, filing a BK is NOT a proceeding to be taken lightly. If you now have better credit than before, a BK will change that in a heartbeat.

Your best bet now is to start repaying them.

When you sign a contract, you agree to the terms of the contract without regard to the condition of the car. Of course, a merchant should be selling mechanically sound cars which will shed a positive light on their store.
