WOW! I didn't think that people like this still existed since the collapse of the Soviet Union and the fall of the n**i's 3rd Reich. These guys called and harrased me and my wife at home and work. They eventually decided to sue us in court. We were served with 30 days to respond, but by the time we actually got the papers from them, we had less than 2 weeks. A friend of ours is an attorney. He tried to negociate with them. Unfortunately they had other ideas. Yesterday they decided to "garnish" my bank account. The only problem is they didn't just take one or two hundred out every month; THEY TOOK EVERY PENNY out of out checking account and savings, with out so much as a phone call. Imagine my wife's suprise when her debit card wouldn't work for a $2 sandwich. Over $2,000 gone. So much for our mortgage payment this month.

In addition, we now have over $120 in NSF charges from the bank for items that bounced as a result; that's just from today! I called the bank to see if I could dispute or reverse the charges, but all their employees could do is give me the phone number for Fred Hannah's office, like that's going to do me any good now. When I asked about closing the account, the bank representative I couldn't until I had a zero balance, as opposed to a negitive one. Unfortunately, I can't even pay the NSF charges until Hannah takes the entire amount from me of over $18,000. CAN YOU SAY "SCREWED!" Now I find out that they are filing another law suit from a different creditor. Don't these people have anything better to do with their time. My guess is that once they find someone to go after, they probably look at their credit report and contact other creditors listed to see if they can represent them, that way they can get multiple settlements from each person that they decide to persecute. It looks like the only way out is to file bankruptsy. At this point I'd rather quit my job and file chapter 7, rather than put one more penny into this guy's pocket. I can only imagine what other people who have no attorney go through. There's no telling how many families this firm has made homeless and destitute through underhanded stunts and legal trickery. Shame, shame!!!

There could be legal precedence here for you to dismiss the garnishment.

Get a different attorney too - If the court documents were not accurate, your "friend" should have been able to spot those and have the lawsuit dropped

Obviously no one showed up to court to fight these scumbags and you got a default judgement.

Fred Hanna, the poster boy for BAD collection agencies has been around a long time. Fred and his sleazy debt collectors have been using intimidation and legal threats as a collection tool for longer than I can remember. If anyone ever decides to do a movie about the disgusting, sleazy, slime-balls of the collection industry, FREDERICK J. HANNA would make the PERFECT model.

It seems that Hanna will lie on court affidavits about his position and most affidavits attached are bogus in the information stated. Fred J. Hanna is NEVER to be trusted, his court filings should ALWAYS be challenged. Fred is concerned about one thing; separating you and your money.

Contact me for referral to a local consumer law professional if you are involved with Hanna.

Did you expect free money...

Sorry to be blunt but what did you expect? Regardless of what ever reason you may have you stopped paying on a debt.

So eventually they decide to file a suit against you. You had an attorney attempt to negotiate on your behalf. This implies that it was a valid suit or he would not of negotiated he would have moved to have it dismissed. He would also be defending not negotiating future suits.

If they got a judgment against you they have the legal right to get an order to attach your bank account(s). It is also legal for them to take up to the amount of the judgment. In the future you can't use that account because anything that goes in will go to them. You need to open another account at another bank and expect within a few months for them to find that one also, where you will have to do the same thing again.

If there are more suits coming you need to take a serious look at Bankruptcy. This will stop any future actions against you. But you don't need to quit your job.
