A Timeshare week was listed on Ebay by HEINCAT. It was for one week annually at the Marriott Waiohai Beach Club in Koloa, Kauai. We saw the listing and called the number in the auction listing to ask whether we could use an escrow company of our choosing. The phone was answered by TREVOR HEIN and he told us we could use our own escrow agent, which made us feel comfortable bidding on the item.
We were the successful bidders and the auction ended at $6,200.
We called TREVOR HEIN after the auction closed to find out which email address we should send the closing documents to. He said that the auction closed at too low of a number and that it should have sold for at least $9,000. He said that Marriott would exercise their Right of First Refusal and that Marriott had told him on the phone that they would do so. THIS IS A LIE. We have purchased on the secondary market for the exact property in the past and Marriott would not disclose whether they would exercise their Right of First Refusal or not. The escrow company we wanted to use does these timeshares all of the time and our agent told us that while Marriott had been exercising their Right of First Refusal on Florida properties, they had not been doing so on the Kauai property.
REGARDLESS, we were the Buyer and it was our right to move forward in the escrow, recognizing that Marriott might exercise their Right of First Refusal and purchase the property at $6200. Obviously Reed Hein Travel/Timeshare Exit Team would receive their money whether it came from us or Marriott.
We called Trevor Hein back and said we would like to move forward. Trevor refused. He said they would not sell at $6200. We missed out on another auction that was simultaneously on Ebay and closed at $7,000 (by a different seller).
We have emailed Trevor Hein and Brandon Hein, demanding that they complete the sale. They have ignored our emails and clearly we are not going to close on this escrow. We looked on their website and see that Timeshare Exit Team CLAIMS to not sell the timeshare, but clearly what they do is sell the timeshare, pocket the money and don't tell the owners of these timeshares that they are actually pocketing the money for the timeshare. They are dishonest!!!
