I was contacted by a gentleman with a thick accent on Monday morning about 9:45am 8/25/08, whom idendified himself as being from Legal Affidavid Office.
He stated he wanted to confirm the last 4 digits of my social security number.

I immediately got suspicious and stated I would not confirm this with him as I did not recognize his company. He was persistant , but I still refused. He then advised me that he was calling in regards to a payday loan that I had not paid that was funded by a US National Bank and that his office would be filing with the courts by 5:30pm that day and that I would be charged with bank fraud, writing a bad check(as apparently they tried to get funds from my account and they were unavailable), and something else, but I could barely understand this man.

I have in the past used payday loans and was sure they were paid off , none the less , this person seemed to be for real as he had much personal information that I often used in the persuit of these loans. He new my email address, alternate contact numbers and even my bank account number. I asked for the name of the payday company, he said that he could not supply this information only that it was funded by US National Bank.

I asked for the original amount, he told me I owed 1,095.00 including fees and if the legal documents they were filing today were filed it could go as high as $5,000 or $6,000. I again argued, I never take payloans higher than 500.00 and was sure I owed no one. I then asked them to send me or email me these documents, he refused saying he could only sent them to my lawyer and wanted my lawyers name and bar#.

I then asked how I could clear this up myself without courts etc. He put me on hold to see if they had some kind of legal document attached to this complaint to see if we could "settle out of court", when he returned he said he was transferring me to someone who could help me. I waited on hold and a gentleman by the name of Justin picked up the phone, he advised me that I could settle this by sending an appolgy letter with 2 reasons why I failed to pay this debt and I would have to pay the $1095.00 today by 5:30pm. The phone line he was on began breaking up tremendously and he was trying to ask me questions about my employer and debts I owed.

I asked for a number where I could call him back , he gave me a 310-747-3307 phone number. I then asked how I am to send this money(I was scared and starting to believe these people) he then put me on hold to find out this information, at this point I hung up. I was very shaken and embarassed to think the authorities would show up at my place of employment. I started looking up the numbers and information of the previous payday loan companies I had dealt with. I contacted them one by one and confirmed my debts paid.

Wanting to leave no stone unturned I even checked my bank statements . I then decided to look up US National Bank and saw a previous rip-off report ,describing the same threats, then I knew this had to be a scam. I the called back the 310-747-3307# and asked for their fax # the man answering the phone wanted my name , I would not give it to him so he said he was unable to give me the fax#, I asked where they were located he would only say California and would not give me the city.
