My ordeal began with a creditor placing a hold on my bank account with Chase on Aug 20,2007. I was in the middle of filing for bankruptcy at the time, but the creditor got to the account before we finalized.
I was upset, but that was thier right. I contacted my attorney and we finalized the bankruptcy on Aug. 22, 2007 in hopes of saving the money that was in the account. (it was every penny I had).

Well Chase was contacted and notified of my filing, and asked to remove the hold on the account. The papers were faxed to them,and the were called.

We recived the typicall phone jocky response,"48 to 72 hours" to process and respond to our request. I was told to follow up in 24 hrs.

Thats when the nightmare got really started. No record of our faxes, Your bankruptcy papers were not enough to lift the hold, you need permission from the creditor. My lawyer was amazed, as was I. We could not speak to any one other than the receptionist. And every time we called we were given a different answer.

I was also calling to inform them that in the account there were child support payments and social security benefits for which I have all documentation and deposit recipts, which must be released because they are both excempt from any levy , garnishment or hold. Not a single person would listen.

I did some research and found that I should go to my home branch and present them with my paperwork proving all of my exempt money. They in turn can callculate the difference and release the rest. I also confirmed this fact with the creditor whom placed the hold on the account. They said fine.

When I got to my home branch and explained my situation, I was greeted with blank stares by the customer service ladies. One then offers to help me and proceeds to call the same phone number I was calling from HOME! She got "they are comingalled funds so there is nothing we can do" I had the documents in hand , AND NO ONE WOULD LOOK AT THEM! Sorry cant help you.

One thing I must explain to you all. The reason there are ss funds in my account is because my fiances son has a heart seriuos heart condition . Hypo Plastic left heart syndrome. Basically, he only has half a functionig heart. This requires daily medication, and regular trips to NYC for doctors appt. and regulation of medication. Also the checking of his pacemaker.

Along with that I have to bring him in by car to his appt. because he cant walk to far or be in subways with extreme heat. All of this takes money. His money being held by Chase which the wouldnt even look at paperwork justifing its release.

This brings us to sat Aug 25. The account hold was lifted.I payed a bill online, got gas this mornig for my trip to work! All is well. Even spoke to a customer rep at chase who crdited me $128 for insufficiant funds for payment made while account was on hold. I reserved a car for monday afternoon to bring my stepson to his cardiologist on tuesday morning before I go to work.

All sound good huh? Chase released the account, my life is back to normal.

NO! At 11 am today Sunday Aug 26 , THEY PLACED THE HOLD BACK ON THE ACCOUNT!

Called chase and no one can say why. Another creditor you ask? No same one, and they deleted the credit to my account which makes it look like it was never released.

My lawyer will call monday. Who knows what they will say then. For now, I dont know what Ill do. Chase obviouslly dosent answer to any one. But I say now, anything happens to my stepson and I cant help because of them, there will be hell to pay.

This doesn't explain the situation at all. YOU are not a relative of the boy. What is going on that the SSI for someone not a direct relative or immediate member of YOUR family going into YOUR bank account?

Seems to me the SSI should be going into the FATHER's bank account. What parts of this story aren't you telling?

This is your fiances son? Who's social security number is the account tied to.

Do you have the account set as required by SS laws? The father or guardian as Reprentative Payee of the minor child and the money is ONLY for the care of the child? If not you might have more problems than you think.

Isn't the SS report due soon? I hope you documented every penny spent for the child and have the balance in the bank.

The SS money for your fiances son is for the kid. Not for your credit mistakes.

I have had this problem before, with a customer. Your blaming the wrong party here. This is what happens; The court orders and levies dept. receives an order from court to put the hold on the account. Once the hold is placed the only person who can lift that hold is the Judge who placed it. Your attorney should know this. He also should know that Chase, as well as any bank's, hands are tied. It is a very frustrating thing but again Chase can't do a thing.

Don't even get me started on obvious poor money management skills, irresponsibility or lack of planning on your part, to have to file bankruptcy in the first place, but to blame Chase is just incorrect. When the hold was placed you were sent a letter as well, from the court who ordered it giving you a time to come to court and be explained the charge. It doesn't sound like you went because if you did, you would have known what was going on, the process, and what to do to resolve it.

Have you tried to contact the people who put the hold on your account? It was more than likely an attorney for the company trying to get the money - but I know the bank I worked at - the party who put the hold on was the party who had to release it. I would find out where it came from and send them the paperwork and try to get the hold released that way. i don't really know if all banks or states work the same - but it can't hurt to try. Good luck.
