On March 30, 2022, my nephew purchased a 2019 Nissan Frontier at Seven Auto Inc. d/b/a East Valley Nissan in Mesa, AZ. Included in this purchase was a Nissan Security+ Plus - GAP Addendum# DA14395762.  The cost of this GAP coverage was $1000 and it was included in my retail sales contract and financed by Arizona Federal Credit Union.

Unfortunately, the vehicle was totaled in an auto mobile accident on November 5, 2022.  He subsequently filed a claim with National Adjustment Bureau, Inc. He submitted all of the paperwork requested in a timely manner.  They kept stalling and stalling.  Finally, He had his attorney for the auto accident contact them to see what the hold up was.  This attorney WAS NOT hired to file a lawsuit against National Adjustment Bureau, Inc.  However, National Adjustment Bureau Inc. ceased all communications with him, his co-signer and attorney at that point.  The attorney explained to them that she was not filing anything against them and that she was only representing me in the auto accident claim. 

After several months, National Adjustment Bureau, Inc. turned the claim over to Nation Motor Club, LLc, who denied the claim stating “Please refer to the back of your GAP contract under EXCLUSIONS: N. any loss resulting directly or indirectly from any dishonest, fraudulent, criminal, or illegal act or arising from an intentional act committed by You. It is acceptable for us to rely on the Primary Carrier’s determination that any total loss arose from any criminal or similar circumstances." HE HAS NOT BEEN FOUND GUILTY OF ANY CRIMINAL OR SIMILAR CIRCUMSTANCES AND THE PRIMARY CARRIER PAID THEIR PART OF THE CLAIM IN THE AMOUNT OF $10,535.10! There was no dishonest, fraudulent, criminal, or illegal act or arising from an intentional act committed by him.  The auto accident is still in the court system and will be for many months.

After doing much research, I have found these companies do this all the time and has many complaints against them. Even if they had justification, which they do not, for denying his GAP claim they still should have paid him the prorated cancellation amount of the GAP policy which was cancelled in December 2022 after the GAP claim was filed.

Consumer complaints have already been filed against National Adjustment Bureau, Inc. in Arizona and Florida with the Attorney General's Offices and the BBB.

Why is the auto accident in the court system?  What were the circumstances of the accident?  Were criminal charges filed?  It doesn't matter if he gets convicted or not, it's a civil matter and has a much lower standard of proof than a criminal case.

Either way, a gap policy is basically a scam.  You are paying an exorbitant rate for a very limited policy that only pays out in rare situations and has many exclusions.
