Like many others who likely received multiple unwanted e-mails regarding Acai Burn, I stupidly decided to try the product after closely reading the Terms and Conditions on the "company's" website, which then had a different URL than it does today (http://acaiburn.net/). At the time I placed the order, I indicated that I did not want any of the other items that were supposedly "free" with the Acai Burn, including some kind of newsletter called Insider Secrets.
By the time I received the package of Acai Burn, however, I had learned enough about the product to know that it didn't work. Thus, within about nine days (from the date of order to the date of receipt), which as all of us who know basic math would agree is less than 30 days, I called the main toll-free number, 888-591-2190, to let them know I wanted to cancel my order and never receive the product again. I also told them that I intended to return the package to them via certified mail, return receipt requested, which I did the next day.
Thinking all was fine, imagine my shock when I saw a charge of $6.95 on my bank statement. I called Acai Burn again, at the toll-free number I had initially called, and was told that I had to place separate phone calls to each different company that produced Insider Secrets and each of the other items that I didn't want, each item I had clarified that I did not want upon ordering the Acai Burn. So I spent quite a bit of time calling each different number and canceling all the items that accompany one's order of Acai Burn whether one even wants these items.
When I asked why canceling the order for everything could not be taken care of through the main number, I was told that Acai Burn was in no way affiliated with any of these other items or companies that produce the items. As a certified paralegal, I believe any judge in the U.S. would agree that because these products accompany only an order of Acai Burn, the companies that produce these products are, in fact, affiliated with Acai Burn.
I also believe a judge would agree that, at the very least, Acai Burn is affiliated with Insider Secrets because both are located at the same street address, 22100 E. 26th Avenue, Aurora, CO 80019. The only difference is that Acai Burn has a post office box or "suite" number of 100, while Insider Secrets does not.
Each time I have contacted either "company", which I did several times in April 2009 and again today, Feb. 10, 2010, the customer service representatives insist that Acai Burn is not affiliated with Insider Secrets (despite, apparently, being located at the same address) or any of the other companies that produce the products that automatically accompany Acai Burn. While Insider Secrets has its own toll-free number, 866-475-1895, it obviously is affiliated with Acai Burn.
The company operating this scam needs to be put out of business and fast. Even its Terms and Conditions are contradictory, obviously not written by an attorney but a con artist. While today's "Acai Pure Total Satisfaction Guarantee" in part reads: "I understand that if I am not fully satisfied with future shipments of Acai Pure, I may return any unopened containers of Acai Pure within 30 days of receipt for a full refund less the five dollars and ninety five cents s/h charge and a 20% restocking fee. If you wish to return your product and receive credit for your return, please contact us." This "Total Satisfaction Guarantee" is followed by a "Negative Option Clause" that in part reads: "I UNDERSTAND THAT THIS CONSUMER TRANSACTION INVOLVES A NEGATIVE OPTION," ... Any Terms and Conditions featuring a "Negative Option Clause" that clearly contradicts a guarantee should always be avoided.
