When my husband and I were moving out of town I put my Kindle fire for sale online at Amazon. I usually sell with ebay but I thought I could try something different and put it for sale on Amazon instead since the Kindle uses Amazon. After a couple of weeks I had a guy buy my Kindle fire HD so I sent him the tablet after I recieved the payment. In less than a month, the guy emails me to refund him because he had accidentally bought two Kindles and wanted to return mine. He also said that if I would agree to send him $40 he would keep the Kindle and give it as a gift.

In return, I agreed to this offer and issued him a refund of $40. I did get a comfimation from Amazon that the $40 was sent to him. All was said and done.. or so I thought. When my husband and I were packing up and moving to another city I have not been able to check my email for awhile due to no internet access. On June 9, 2013 he wrote to me saying that he was cancelling the return request. On July 14, 2013 I had found out that he had filed an a to z claim on me in the middle of June.

He claimed that he never recieved the $40 refund and wrote on the claim that he was going to send me the Kindle back if he didnt get his refund. I called Amazon seller support and the represenative that I spoke with told me to not worry about it. He said that I could appeal to it and work it out with the buyer. But then after numerous calls Ive made to seller central, nothing was happening. Each of the represenatives always told me something different. One told me to email the problem to sellercenteral and the other to guarentee claims.

Another represenative told me I could report him to fraud because he was not working this issue out with me. I later found out from an Amazon represenative that the buyer did not authorize the $40 charge onto his account, therefore he was not refunded on HIS behalf. He also wrote in his email that he has decided to keep the Kindle and for me to send the Kindle. After all of this, I was notified that he was getting his refund of $305! And he had won the case just because I didnt reply back.

It is not fair to buyers because I was not aware of this. It was my first time selling on Amazon, and I get stuck with sucky customer service and a fraudlent buyer. He later ignored my emails about returning my Kindle. He now has his full refund and my Kindle and Amazon doesn't want to do anything about it. They said they couldnt cancel the refund without the buyers consent, but in all the emails it even shows how the buyer planned on keeping my Kindle all along and just wanted the $40 into his account.

I later reported him to violating the community rights, but nothing happened as expected. I am pissed because I just lost my Kindle fire that was worth well over $300 and lost $305 in return plus the shipping costs. Please, I need some legal help here. I just feel like I had no rights at all!! I refuse to pay my Amazon account balance because I feel like this was a fradulent case.

If Amazon is willing to take my money and give it to this fradulent guy named Gerry D. Evans. They should at least investigate him and do something about it. I want my money back!
