Ascendtech.us Bought a laptop battery and received an old used one. Willoughby Ohio

I ordered a laptop battery and it arrived and appears to be an old, used battery. The case has scratches and wear marks on it. Nothing in the order said that I was getting a used battery. When I complained, I received this reply:

"Our terms of sale section states that ascendtech.us carries a mixture of new, used, surplus, and recertified products. We did not advertise this battery as new. It is in a working condition. If you want to send it for a refund there will be no shipping refunded and there will be a 20% restocking fee."

Nothing in their ad says that the battery is "used" either!

There is a huge difference in purchasing a use piece of a hardware or a battery. Batteries have limited life and this battery could fail anytime. This is a total misrepresentation and a underhanded way of doing business.
