So Asset Acceptance contacted me over a year ago about a few outstanding debts. I told them I couldn't pay then. They kept calling me though. A few times a month, until I complied with a payment arrangement. So I've been paying them $100 a month. For the last 8 months it's been fine. I don't get phone calls, as long as they get the money. They even offered me a deal on one of the accounts to pay half of it all at once and they'd take it off my Credit Report. But I'm still paying on another account. I only have less than $200 left to pay. but I couldn't afford it this month.

I call to tell them not to take the money out of my checking account. That there isn't money in the account for them to take. And that I would call them when I am able to make the final payments. The rep [Mellissa] tells me the check was already being processed, and I'd be charged a fee for it coming back with insufficient funds. On top of my bank charging me another $30 for it.

But when I was telling the rep that I can't pay now, and I don't know what day I'd call to do the last payment she became insistent I give her a set date. When I explained that I'm poor and can't set a date she hung up on me.

Has anyone else had this happen? And what did you do about it?

They could have let you slide since you were making good payments and they may have had you been able to tell them when your next payment would be. When you make a payment agreement and you do not stick to it, even if the reason is legit, they do get ruthless. Be careful. They may renege on whatever promises they made to you when you agreed to the payment arrangement. If they gave you money off on your balance, or promised to delete the entries from your reports, or whatever, they may go back on their word because you defaulted on your end of the bargain.

I understand you fell on hard times, but since you could not give them the date that you would resume payments, they did not accept your excuse.

Since you believe on paying off your debts, even if they are old, here is what you may want to consider doing next time. Rather than make a payment arrangement with them, make an arrangement with yourself and put the money into a savings account every month. So what if they keep calling you. When you have enough money to pay the debt, contact them for a lump sum settlement and pay them off. Make sure you get the settlement terms in writing B4 you pay them. Usually when you make a settlement lump sum payment, it does not restart the 7 year clock or the SOL because you did not enter into a payment agreement with them. You merely paid your old bill.

It's not a matter of not knowing what I'm doing. The account they have the information for is set up just for this. And will be closed when debts are paid.

And it turns out it is only $128 left to pay. What these people don't seem to understand is I've fallen on hard times and can't afford the set payments and can't promise a set date to pay the remainder. They've continued calling me since she hung up on me, just to be even more rude and callous. It's not that I'm not going to finish paying. I am. I just can't atm.

And why would I not pay the debt I know for a fact that I owe. Sure, these people suck at their job when dealing with the public, but I'm trying to fix my debt, not further it.

When you have $5 to your name, the last thing you need is some a*****e on the phone telling you what to do. And talking to anyones supervisor there is even more futile. They must get trained to be this way. What I can't understand is how they can live with themselves.

Doing your job is one thing, but there are certainly nicer ways to do it.

It's the harassment and horrible treatment I can't deal with. Not the debt.

Crystal,

This is a perfect example as to why you should NEVER speak to ANY third party debt collector on the phone. This is where your problems started.

Then you compounded your problems by making an agreement to pay, and then making payments. Then, you gave them access to your checking account! What were you thinking???

By doing this, you have legally affirmed the debt to Asset Acceptance, AND you have restarted the Statute of limitations on the debt for legal enforcement of collection.

DO NOT listen to morons giving advice such as this "borninohio" person. NOTHING this person said is accurate, nor does it apply to your situation.

At this point, you have limited options as Asset Acceptance will now sue and win, and get a judgement against you which will result in wage garnishment and/or asset siezure.

The first thing you want to do is close that bank account and open one at a DIFFERENT BANK. This is imperative.

The second thing you need to do is go get a good bankruptcy attorney, as it is obvious you are not capable of handling anything for yourself.

Or, you can just wait for the summons.

Depending on your state and the type of account and the original opening date of the account your accounts may be outdated enough that Asset Acceptance cannot collect on them.

Do research on the internet to find consumer laws pertaining to old accounts, etc and you should be able to find a website that has the cut off dates that a old account can be collected on or not.

You can ask your bank to put a Block on any further attempts by Asset Acceptance to withdraw money from your checking account. They usually have a fee they charge for that service.

The best way to pay Asset Acceptance if you are going to pay them anything is by a money order. That way you pay a set amount and Asset Acceptance does not have any of your personal banking info like your checking account number.

Do not let Asset Acceptance tell you that you must pay by check, etc. You can pay them by a money order. If they really want to get paid they will accept a money order.

You have rights as a consumer and do not let Asset Acceptance take those rights away.

Do research on the internet on things before paying Asset Acceptance any more money. Do not let them scare you by them saying they will garnish your wages, etc, as they cannot do that without going thru the courts and if they would do that you can fight it and win.

A lot of the time if you do owe Asset Acceptance they will settle for half or less of the account amount since they are profiting even then on the settlement.

Do research on the internet on Federal Consumer protection laws and gain some knowledge of things in your favor to help fight Asset Acceptance
