1995 I co-sign on a auto loan in Georgia. finance by Bank Of America. vechicle was repossessed in 1998. Bank Of America refused to tell us the location of the vechicle, when was it going to be auction and where it would be auction, how much was it sold for, when was it sold and what was the balance. this was never sent to the owner nor the co-owner. expensive items was all gone and no one had to answer for it. we both waited for paper work to come to us, In the meanwhile we both submitted letters to the three credit bureau's (Experian,Equifax, and Transunion) that a repossession had been place on our credit report and could they please start a investigation. we both received our investigative reports back with Bank Of America account deleted off our credit report. I have the proof, this was done 1998 the same year they took the car. now here it is 14 years later and Bank Of America has sold the account to a company name New Century Finance who is being represented by Pressler & Pressler. I am the co-signer and yet my name is not on the levy. I already have a report on Presssler & Pressler. I also wrote a rebuttal that was completely false. the court clerk stated to me that the judge went against the collection agency, instead he ruled against me. my Social Security money is still held hostage. oh" before I forget, in reference to the person who made the comment.when your cancer medications makes you incapitated that you can not function to pay a bill and everyone around you is untrust worthy and money is disappearing,I hope and pray for your sake you have a child or children in my case that I can give them control of everything I have and it is always there and records are kept for my viewing along with bank statements, so before you voice your opinion on a situation, keep it to yourself unless you are living it or personal involved.stay out of my koolaid, you have no idea what flavor it is. now to get back to the important points of this situation. this account should have been handle differently by Bank Of America because the three credit bureau sent them notificatin and the verification to them in 1998.  if there is a Attorney who knows this is a big character of in justice because now it is not about anything except the suffering and pain and the expenses this has cost me and my family. this should not have happen now or ever again to a consumer. when will this end, again the judges in America is being scam again, first it was the mortgages and now it is the debt collectors who some is actually attorneys. I am not saying you do not have the right to buy debts, just make sure it is a legimate one,by holding whom ever the original creditor the responsibility of selling you a debt that was accompany by the original contract and what recourses was already taken on the processing of delinquent accounts.

You are still obligated to payoff the balance

AUTHOR: Steven - (U.S.A.)

POSTED: Saturday, June 02, 2012

Anytime a car is repo'd the car is sold. You don't really have a need to know where the auction is or anything else. After the car is sold if there is a difference in what the car was bought for and the balance due on the loan you are expected to pay the difference if there is one (same thing goes if they sold the car for more than you owed they would pay you that money).

Evidently you thought just because you no longer owned the car you were not supposed to pay the difference. I find it hard to believe that you received no letters from the bank stating that this balance was still due and asking you to pay it (maybe you moved and didn't provide an address change).

If you or the co-owner did not try to claim property it was probably kept or thrown away. I find it hard to believe that you were never told who repo'd the car or where to go to claim any property.
