Hayward Main Branch's Sr. Personal Banker and others transferred $120,000 to an unknown party by forging my signature, having two tellers authorize transfer, knowing that it was not me transferring the money.   I am well known at the branch since all my mortgages and banking has been done at that branch for 51 years.

The bank conducted business violating my rights as a consumer, as achecking account and line of credit customer, and the security of the bank towards a customer is not there, it has been violated, quoting Mr. Moyihan "..trust is at the heart of what we do.  Our customers and clients want to know they are doing business with a financial services company that they can trust,....that make clear, honest and ethical decisions..." .  This completely contrary of what he says because the Bank will not after 5 years admit they made a gross error and return the money, they said there was insufficient evidence on the first investigation and the same results on the second investigation Sept 2013.

I have communicated with Bank of America Office of the CEO and President thru various persons, and after 5 years (transfer date was 01/28/2008) I was told last week by their representative that they found no problems after two internal investigation even though I presented them with copies of documents including the signature card for me and my wife, that clearly shows it not me.

We are Senior Citizens presently 71 years old and are paying on this money while someone else is enjoying it, who knows whom.   We had no clue this happened until we received our checking account monthly report.

Above said banker approached me at the bank and asked me to lend some money to one of her wealthy client for a month and I said I did not have that kind of money to lend to an unknown person.  She insisted and trusting her expertice as a banker she said she could increase my line of credit by the 120k.   Wife and I signed documents without a Notary being present, and from there on she took over my line of credit by transferring $25,000 right from Farmington Heloc FDES NNC, then a teller dvance of $95,000 at Banking Center in Hayward Main, to our checking account without us requesting it, signing for it, giving permission, POA, etc.   That was the very same day that the $120,000 were transferred from our checking account to an unknown party to us, and two tellers approved it, knowing it was not me.

How that was managed is unknown to us other than she could have had accomplices or subordinates to help do this.  The line of credit documentation was never signed by Bank of America until 3/7/2008 in Florida.  That is 45 days later, and the Deed Of Trust was recorded 52 days later on 4/14/2008.  The document clearly states that a BofA person has to approve the documents before any money is withdrawn from the line.   How did the bank allow an employee to break all the rules and get away with it by not being monitored, having no one to respond to, and get away with it.  

Bank of America sent us an account history on October 22, 2012, and calls those transfers electronic advance, and my original statements calls the 95k electronic advance, the 25K balance advance, and the 120k advance from my line to my checking an electronic advance.   The bank has not been able to produce a transaction number or copy of a document where we asked for this money.   Our Sr. Personal Banker just took over our accounts, without permission, without our signature, without a Power of Attorney, etc. comitting fraud over and over, and we were told by Bank of America to go find that person and ask for the money.   It was money under Bank of America's guard, and they are responsible for negligence to uncover irregularities in their organization.

On 12/29/2010 we filed a complaint with help.consumerfinance.gov/app/account/complaints/list, OCC US Dept. of the Treasury, and in Sept 9, 2012 BofA wrote to OCC that they considered the case closed.   We need help with this matter, we were told by their representative to look elsewhere for help, because Bank of America closed the case.

They were playing with us for us not to take them to court because we are old an don't have the money to do that.  We are looking for an attorney or a government agency to help us on this fraud case by Bank of America for $120,000.
